A. 
To ensure that the public can have complete confidence in the integrity of the Village of Darien, each elected and appointed official and each employee shall respect and adhere to the fundamental principles of ethical service. The proper operation of Village government demands that:
1. 
Village officials and employees be independent, impartial, and responsible to the people;
2. 
Decisions be made within the proper channels of the Village government structure;
3. 
Village officials should not be used for personal gain;
4. 
Village business should be conducted in such a way so as to reenforce the public's confidence in its integrity.
B. 
In recognition of these fundamental principles, there is hereby created a Code of Ethics.

A. 
The purpose of this code is to establish ethical standards of conduct for all Village officials and employees by identifying those acts or actions that are not compatible with the best interest of the Village.
B. 
The provisions of this code, and such rules and regulations which may be established, are to be interpreted in the context of the above principles and are deemed to be in the best interest of the public.

Village officials and employees are agents of public purpose and hold office to serve the public interest. They are found to uphold the Constitution of the United States, the Constitution of the State of Wisconsin, and to carry out efficiently and impartially all laws of the United States, the State of Wisconsin, and the ordinances of the Village of Darien. Further, they are found to observe, in their official acts, the standards of ethics set forth in this code and to faithfully discharge the duties of their office. The public interest must be their primary concern.

This code governs all Village officials, whether elected or appointed, paid or unpaid, including members of boards, committees, and commissions, public officers, department heads, and Village employees.

A. 
In accordance with Wis. Stats. Section 19.59(1m), the Ethics Code, incorporated by reference, is hereby adopted and made part of this Code of Ethics.
B. 
Additionally, there are certain provisions of the Wisconsin Statutes which should, while not set forth herein, be considered an integral part of any Code of Ethics. Accordingly, the provisions of the following sections of the Wisconsin Statutes are made a part of this chapter and shall apply to public officers and public employees, whenever applicable:

No Trustee, other public official, or employee shall, without proper legal authorization, disclose confidential information concerning the property, government, or affairs of the Village, nor shall be or she use such information to advance the financial or other private interest of himself or herself or others.

No Trustee, other public official, or employee, firm, or partner whose salary is paid in whole or in part by the Village shall appear on behalf of private interests before any agency of the Village. He or she shall not represent private interests in any action or proceeding adverse to the interest of the Village in any litigation to which the Village is a party.

No Village employee or officer who, in his or her capacity as such officer or employee, participates in the making of a contract in which he or she has a private pecuniary interest, direct or indirect, or performs in regard to that contract some function requiring the exercise of discretion on his or her part, shall enter into any contract with the Village unless within the exceptions set forth in Section 946.13 of the Wisconsin Statutes. The provisions of this section shall not apply to the designation of a public depository of public funds, nor to contracts for the purchase of commodities in any one year under $300.
