No person, firm, corporation or entity shall willfully ignite, fire, shoot, set off, use, burn, explode or fire off any firecrackers, fireworks, torpedoes, bombs, rockets, pinwheels, fire balloons, Roman candles, toy cannons or other fireworks of any kind, character or nature within this City excepting, however, subject to Chapter 320, RSMo., and all other Statutes, laws and regulations of the State of Missouri, during the period of July second (2nd), third (3rd), fourth (4th) and fifth (5th) of each year between the hours of 9 A.M. and 10 P.M. of each of said days during said period and only with respect to firecrackers, fireworks, torpedoes, bombs, rockets, pinwheels, fire balloons and Roman candles; provided however, that this Section shall not apply to parks or other places when same are in the charge of competent persons and under a permit issued by the Board of Aldermen subject, however, to the laws, Statutes and regulations of the State of Missouri including Chapter 320, RSMo.

A. 
No person, firm, corporation or entity shall sell or expose for sale any fireworks, firecrackers, torpedoes, bombs, rockets, pinwheels, fire balloons, Roman candles or toy cannons or any other fireworks of any kind, character or nature within this City excepting, however, subject to Chapter 320, RSMo., and all other Statutes, laws and regulations of the State of Missouri during the period of June twenty-fifth (25th) through and including July fifth (5th), both dates inclusive, of each year during which said time any person, firm, corporation or entity to whom or which a valid permit required by Chapter 320, RSMo., and City seasonal fireworks merchant license have been issued pursuant to Chapter 605 of the Municipal Code of the City of Hayti, Missouri, may sell or expose for sale said items; provided however, this Section shall not be construed to prohibit the sale of fireworks in wholesale by an appropriate licensee to an appropriate licensee licensed to do business within the City of Hayti or for use within the City limits in the manner permitted by the Board of Aldermen as hereinafter set forth, all subject to the Statutes, laws and regulations of the State of Missouri including Chapter 320, RSMo.
B. 
The City's Building Official shall perform such inspections as are necessary to insure compliance with this Section and with Chapter 320, RSMo. Funds derived from the issuance of licenses shall be utilized for the performance of such inspections.

Upon proper application made to the Board of Aldermen by any person, firm, corporation, entity or a group of persons or an organization desiring to display fireworks by firing and shooting off same in celebration of an event or historical date subject to Chapter 320, RSMo., and all other Statutes, laws and regulations of the State of Missouri, the Board of Aldermen is hereby authorized to grant permission to fire and shoot off fireworks, provided however, that such display of fireworks be in the charge of a competent person or persons and that the place selected for the display is such that the firing or the shooting off of fireworks will not endanger life or property.

A. 
Refuse Burning Restrictions. The following restrictions shall apply to the burning of refuse:
1. 
Except as provided for herein, no person shall conduct, cause, permit, or allow the disposal of tires, petroleum-based products, salvage operation waste, asbestos-containing materials or other waste or refuse by open burning, except as provided for herein.
2. 
Open burning of tree leaves and yard waste. The open burning of leaves and yard waste, as defined in Section 235.010 of the City Code, shall be allowed, but only between the hours of 8:00 a.m. and 6:00 p.m., unless otherwise authorized by the Fire Chief or his designee. All such yard waste may only be burned on the property upon which it was generated.
3. 
Open burning of household or domestic refuse. Burning of household or domestic refuse shall be allowed, but is limited to open burning between the hours of 8:00 a.m. and 6:00 p.m. on a residential premises having not more than four (4) dwelling units, provided that the refuse originates on the same premises.
4. 
Recreational burning. Campfires and other fires used solely for recreational purposes, ceremonial occasions or for the outdoor non-commercial preparation of food are hereby permitted. All such burning must be conducted in compliance with state and federal regulations relative to open burning.
5. 
Designation of "no burn" days. The Fire Chief or his designee is hereby authorized to designate individual days as "no burn" days for all open burning within the City. On days designated as "no burn" days, all open burning is prohibited, except cooking fires and any fires specifically permitted by the Fire Chief or his designee. On all other days, open burning shall be allowed, subject to any applicable restrictions contained in the City Code. The designation of "no burn" days shall be subject to the discretion of the Fire Chief or his designee, but shall be based upon one (1) or more of the following criteria:
a. 
Atmospheric conditions that prevent smoke from rising freely;
b. 
When excessively dry conditions exist;
c. 
Sustained winds greater than fifteen (15) miles per hour; or
d. 
Frequent wind gusts greater than twenty-five (25) miles per hour.
6. 
Burning in street prohibited. No open burning of any kind shall be allowed in the paved portion of any public street.
B. 
Any violation of this section shall be punishable by a fine not to exceed five hundred dollars ($500.00) or by imprisonment in the County jail not to exceed ninety (90) days, or by both such fine and imprisonment.

A. 
Except as provided in Subsection (B), a fee of one thousand dollars ($1,000.00) is hereby established and shall be charged for each and every response to a fire or emergency outside the City limits of the City of Hayti by the Fire Department of the City of Hayti, which fee shall cover the response and the first two (2) hours spent in combating the fire or emergency. In addition, a fee of two hundred fifty dollars ($250.00) shall be charged for each additional hour over two (2) hours spent in combating the fire or emergency. The cost to the Department of any supplies expended in combating the fire or responding to the emergency shall also be added to the fees established hereby.
B. 
For any emergency response outside the City limits by the Fire Department solely for the extrication of a person from a motor vehicle a fee of one thousand dollars ($1,000.00) is hereby established and shall be charged to the owner of the vehicle for each and every such response.
C. 
The fees established herein shall be the responsibility of the owner of the property involved in the fire or emergency whether such property is real property or personal property and if more than one (1) property is involved, each such property owner shall be jointly and severally liable for the fees established hereby.
D. 
All fees charged and received for fires or emergencies outside the City limits of the City of Hayti shall be deposited as follows: one-half (½) to the credit of the General Fund of the City of Hayti and one-half (½) to the credit of the Fire Department Equipment Fund of the City of Hayti.

A. 
The Fire Chief, on behalf of the City of Hayti, is hereby authorized and directed to participate in the State of Missouri's Hazardous Substances Emergency Response Cost Recovery Program in accordance with Sections 260.500 to 260.552, RSMo.
B. 
The Fire Chief is directed to provide an itemized statement for all eligible costs to all responsible parties within sixty (60) days from the date of the response to any hazardous substances emergency situation. Such statement shall be submitted in compliance with guidelines established by the Missouri Department of Natural Resources.
