The owner, occupant or tenant of any real estate fronting upon or alongside of any of the streets of the Borough of Kenhorst is hereby required to remove, or cause to be removed, from any paved or unpaved sidewalk or pedestrian walkway in front of or alongside of said real estate all snow, ice or sleet thereon fallen or formed within 12 hours after the same shall have ceased to fall or to form. Provided: that snow or ice that has ceased to fall or to be formed after 6:00 of any evening may be removed at any time before 6:00 p.m. of the following day.
The owner of such real estate shall be responsible for conforming to the requirements of this article where such real estate is occupied by such owner or is unoccupied; the tenant or occupier thereof where such real estate is occupied by such tenant or occupier only; and the owner thereof where the real estate is a multiple-business or multiple dwelling property, occupied by more than one tenant or occupier.
In any case where the owner, occupant or tenant as aforesaid, shall fail, neglect or refuse to comply with any of the provisions of this article within the time limit prescribed in § 404-12, the Borough may proceed immediately to clear all snow and/or ice from the sidewalk of such delinquent, and to collect the expenses of such removal, with an additional amount of 10% from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed under § 404-15 of this article.

Any person or persons violating any of the provisions of this article shall be punishable as provided in Chapter 1, Article I, Enforcement; General Penalty, of this Code.

It shall be unlawful for any person, whether owner, occupant, tenant, or agent thereof, in removing snow or ice from property fronting upon or alongside of any of the streets of the Borough of Kenhorst, to cast, plow or deposit snow or ice from said property, its sidewalks, driveways or other areas, onto the streets, cartways or public roads of the Borough of Kenhorst at any time after said streets, cartways or public roads of the Borough have been cleared of snow and ice by plowing, shoveling and salting or cindering thereof by the Borough. It is the property owner's responsibility to inform any snow removal contractors of the requirements presented herein.

It shall be unlawful for any person to relocate any accumulation of snow in the Borough streets or public pedestrian walkway other than to private property which will cause or tend to cause an obstruction to vehicular traffic or hamper snow removal efforts by the Borough.
