A. Purpose. The purpose of this regulation is to control the
division of land within the incorporated area of Berkeley, Missouri,
in order to promote the public health, safety, and general welfare
of the City by regulating the division of land in order to lessen
congestion in the streets and highways; to further the orderly layout
and appropriate use of land; to secure safety from fire, panic, and
other dangers; to prevent the overcrowding of land; to avoid undue
concentration of population; to facilitate adequate provision for
transportation, water, sewerage, schools, parks, playgrounds, and
other public requirements; to facilitate the further division of larger
tracts into smaller parcels of land; and, in general, to facilitate
the orderly development of the incorporated area of Berkeley.
B. Application Of Regulations. The St. Louis County Recorder
of Deeds shall not record a subdivision of land located in the incorporated
area of Berkeley until a plat of the subdivision of land has been
approved according to the requirements and provisions of these regulations.

As used in this Chapter, the following terms shall have these
prescribed meanings:
ALLEY
A minor way used primarily for vehicular service access to
the rear or side of properties otherwise abutting on a street.
BLOCK
An area of land entirely surrounded by public highways, streets,
streams, railroad rights-of-way, parks, or other similar areas or
facilities.
BUILDING LINE
A line on a plat generally parallel to the street right-of-way,
indicating the limit in front of which a building may not be erected.
COMMISSION
The Plan Commission of Berkeley, Missouri.
COMPREHENSIVE PLAN
A plan or any portion thereof adopted by the Plan Commission
for the coordinated physical development of Berkeley, Missouri.
COUNCIL
The City Council of Berkeley, Missouri.
DEAD-END STREET
A street having only one (1) end open for vehicular traffic
and the other permanently terminated by a turnaround for vehicles.
EASEMENT
A grant by a property owner to the public, a corporation,
or a person of the use of land for a specified reason.
ENGINEER
A professional engineer registered in the State of Missouri.
FRONTAGE
That edge of a lot bordering a street.
IMPROVEMENT PLANS
The engineering plans showing types of materials and construction
details for the physical structures and facilities to be installed
in conjunction with the plat.
IMPROVEMENTS
Street pavements, sidewalks, pedestrian ways, water mains,
storm sewers, sanitary sewers, treatment plants and sewerage disposals,
street signs, monuments, landscaping, street lights, and other similar
items.
LAND SURVEYOR
A land surveyor registered in the State of Missouri.
LOT
A platted parcel of land intended to be separately owned,
developed, or otherwise used as a unit.
LOT AREA
The total horizontal area within the boundaries of a lot
exclusive of any area designated for roadway purposes.
LOT, CORNER
A lot abutting upon two (2) or more streets at their intersection.
LOT, DOUBLE FRONTAGE
A lot having frontage on two (2) non-intersecting streets
as distinguished from a corner lot.
PEDESTRIAN WAY
A right-of-way dedicated to public use which cuts across
a block to facilitate safe pedestrian access to adjacent streets and
properties.
SLOPE
The degree of natural inclination of the ground.
STREET
A general term denoting a public or private thoroughfare
which affords the principal means of access to abutting property.
The term includes all facilities which normally occur with the right-of-way;
it shall also include such other designations as highway, thoroughfare,
parkway, throughway, road, pike, avenue, boulevard, lane, place, court,
but shall not include an alley or a way for pedestrian use only.
STREET, MAJOR (ARTERIAL)
A street designed or utilized primarily for high vehicular
speeds for heavy volumes of traffic on a continuous route with intersections
at grade.
STREET, COLLECTOR
A street designed to carry traffic from minor streets to
the major system of arterial streets.
STREET, FRONTAGE OR SERVICE
A minor street parallel to and adjacent to arterial streets
and highways, which provides access to abutting properties and protection
from through traffic.
STREET, MINOR
A street of limited continuity which serves or is intended
to serve the local needs of a neighborhood, and which is used primarily
for access to abutting properties.
SUBDIVISION

1.
A division or consolidation of land into lots, tracts, sites
or parcels, for the purpose of transfer of ownership, leasing, or
building development.
2.
The dedication or establishment of a road, highway, street,
alley, pedestrian or public way, or public easement.
3.
The resubdivision of land previously divided or platted into
tracts, lots, sites, or parcels.
4.
All land or buildings hereafter converted into or to be utilized
as condominiums.
SUBDIVISION, MINOR
The division or consolidation of not more than four (4) buildable
lots shall be classified as a minor subdivision, provided:

1.
The proposed subdivision of land does not include an improvement
within a street right-of-way, other than concrete sidewalks.
2.
The proposed subdivision of land does not include a provision
for a public area or public facility.
3.
The proposed subdivision of land does not adversely affect the
development of the parcel proposed for subdivision or adjoining property.
4.
The proposed subdivision of land is not in conflict with any provision of the Berkeley Zoning Code in Chapter
400 of this Code or these subdivision regulations.
