As used in this Article the following terms shall have these
prescribed meanings:
MOTOR VEHICLE
Any automobile, truck, or other self-propelled vehicle operated
over and on the streets and highways.
PARKING LOTS
Any outdoor space or uncovered plot, place, lot, parcel of
real estate where motor vehicles may be parked, stored, housed, or
kept.
PERSON
Any person, firm, partnership, association or corporation
or organization of any kind.

It shall be unlawful for any person to conduct the business
of renting of motor vehicles or the storing of same for the purpose
of renting without first obtaining a license therefor in the manner
hereinafter set forth.

A. Applications
for licenses required by ordinance shall be made to the Director of
Finance on the forms prepared by the Director.
B. Along
with such form, there shall be filed a plot plan of the parking lot
showing location, exits and entrances, size of lot, attendants, buildings,
hours when attendant will be on duty, lighting, rates to be charged,
and other information as required.

Prior to the issuance of any business license herein, the applicant must secure an additional land use permit, pursuant to Chapter
400, Zoning, of the Municipal Code of the City, and receive approval of the Director of Public Works relative to the construction of the parking lots and all buildings.

A. Each
motor vehicle parked or stored within the City shall have, attached
to the front windshield in the lower right corner, a City tag which
shall be secured from the Director of Finance. Such tag shall be valid
until the thirty-first (31st) day of January of each year. No motor
vehicle which is to be rented from any parking lot in the City shall
be parked, stored in the City, or driven upon the City streets without
such City tag.
B. The
cost of each such tag shall be five dollars ($5.00). No tag shall
be transferred to any other vehicle, and shall be used on the vehicle
to which it has been issued.
C. An
application for such tag shall be made to the Director of Finance
providing the following information:
1. A brief description of the motor vehicle, including the name of the
manufacturer and motor number.
2. Name and address of owner, and additional information as required.
3. The Director of Finance shall assign a number to such motor vehicle
tag.

Any person parking or storing any motor vehicle within the City of Berkeley for the purposes of rental or leasing is hereby designated as doing business within the City and shall be subject to the Merchant License and shall secure a Merchant License and pay any and all taxes as required by Chapter
605, Merchants' and Manufacturers' Licenses, of the Municipal Code.

Every parking lot shall be paved with asphalt or other similar
paving as approved by the Director of Public Works, and be kept clean
and free of litter and debris.

Any person violating any of the provisions of this Article shall
be, upon conviction thereof, fined not exceeding five hundred dollars
($500.00), or by imprisonment in the City Jail not exceeding twenty
(20) days, or by both such fine and imprisonment. Each day such violation
is committed, or is permitted to continue, shall constitute a separate
offense and shall be punishable as such hereunder.
