The purpose of this Chapter is to allow for the reasonable disposal
of surplus personal property while protecting the character of residential
areas, providing for safe traffic flows, protecting businesses from
unfair competition and maintaining the safeguards within the current
Business Regulations code.

As used in this Chapter, the following words and terms shall
have the following meanings:
GARAGE SALE
All general sales, open to the public, for the purpose of
disposing of personal property, including, but not limited to, all
sales entitled "garage," "lawn," "yard," "attic," "porch," room,"
"back yard," "patio," "flea market," or "rummage" sale. This definition
shall not include a situation where no more than five (5) specific
items are held out for sale and all advertisement of such sale specifically
names those items to be sold.
PERSONAL PROPERTY
Property that is owned, utilized and maintained by an individual
or members of his/her residence and acquired in the normal course
of living in or maintaining a residence. It does not include merchandise
which was purchased for resale or obtained on consignment.
RESIDENTIAL ZONES
All zones within the City of Camdenton Code of Ordinances
which are used primarily for residential, non-commercial purposes,
i.e., "R-1," "R-2," "R-3," "R-3TH," "RP" and other zones which may
be enacted of similar nature.
RESIDENTS
Those individuals meeting qualifications as a registered
voter whether registered or not registered.

A. Any garage sale shall be operated only with a valid permit issued
by the City of Camdenton. Application for a permit may be made only
during working hours for the City of Camdenton at least twenty-four
(24) hours prior to the start of any proposed sale. Any permit issued
shall specify a specific time and duration which shall be no more
than forty-eight (48) consecutive hours. Garage sales may only operate
between sunrise and sunset when there is sufficient natural outdoor
light. Personal property being sold at the garage sale may not be
located or displayed within any public right-of-way, including the
parking areas of the quadrants of the square at the intersection of
Highway 54 and Business Highway 5.
B. Residential Zones. Garage sales in residential zones shall be limited
to not more than two (2) times per year upon any residential parcel
of land. Each permit must be for a specific parcel and application
shall be made only by the owner or valid lessee of the property. Multiple
residents at one (1) site require only one (1) permit although all
residents shall be listed on the permit.
C. Other Than Residential Zones. Garage sales in other than residential
zoning shall be limited to not more than one (1) time per year. Each
permit must be for a specific parcel and shall require written permission
from the owner or valid lessee of the property. Multiple individuals
may sell at one (1) site with only one (1) permit although all individuals
selling items shall be listed on the permit. Personal property to
be sold at the garage sale shall not be displayed in parking lots
of retail shopping centers with parking areas which are used in common
with other businesses in such shopping center unless the applicant
obtains written permission from all businesses in the shopping center.

A. The provisions of this Chapter shall be modified as follows:
1.
Persons selling goods pursuant to an order or process of a court
of competent jurisdiction or public officials acting in accordance
with their official duties shall be exempt from the requirements of
this Chapter.
2.
The City of Camdenton may designate certain days and times as
"Citywide Garage Sale Days" wherein any person or entity may sell
garage sale items only during said times without a permit (and such
sales shall not count toward the limitation on numbers of sales herein).
Personal property being sold at such garage sale may not be located
or displayed within any public right-of-way, including the parking
areas of the quadrants of the square at the intersection of Highway
54 and Business Highway 5.
3.
Charitable organizations or government organizations selling
items where proceeds are used for the organization may have no more
than two (2) such garage sales per year, regardless of the zoning
district, and such sales shall require only one (1) permit issued
in the name of the organization.

Failure to secure a permit shall be deemed a violation of the Camdenton Code of Ordinances and subject to the penalty set forth in Section
100.220.
