Apiaries not on commercial farms shall be permitted if they
meet the following criteria:
A. All colonies shall be kept in movable frame hives in accordance with
N.J.S.A. 4:6-10.
B. There is adequate fresh water available of at least one gallon per
hive per day during brood rearing at apiary site.
C. No colony shall be placed closer than 10 feet from an adjoining property
line, unless it is placed behind a six-foot-high solid fence or hedge
parallel to the adjoining property line extending 10 feet beyond any
colony.
D. No colony shall be located within 25 feet of a public sidewalk, alley,
street or road.
Apiaries on commercial farms, such as defined in N.J.S.A. 4:1C-1
et seq., are not permitted.
Hobbyists may keep up to three apiaries as defined in §
396-3.
Any person who shall be found guilty of violating this article shall be subject to a penalty as set forth in Article
XI, Violations and Penalties, of this chapter.
