No person shall operate, or allow to be operated, a vehicle,
which is powered by an internal combustion engine, on Route 65 between
the boundary line between Edgeworth Borough and Leetsdale Borough
to Spencer Street, while utilizing in said operation an engine brake
retarder which has an improperly maintained, defective, or modified
exhaust muffler which is thereby not sufficient enough to prevent
the cause of excessive noise of said vehicle.
Any person, firm, operation, or organization violating any of
the provisions of this article shall, upon summary conviction, be
sentenced to pay a fine of not more than $1,000 per occurrence and
cost of prosecution, and in default of payment thereof shall be sentenced
to undergo imprisonment for a period not to exceed 10 days.
Pursuant to the procedures of the Commonwealth of Pennsylvania,
Department of Transportation, and pursuant to the regulations of the
Department with respect to signs on highways, the Borough of Leetsdale
shall cause to be erected upon the roadway herein specific signs regarding
the prohibition of the use of said engine brake retarders with improperly
maintained, defective, or modified exhaust mufflers on the designated
highways.
This article shall be enforceable by the Borough of Leetsdale
Police Department.
Any ordinance or resolution conflicting or inconsistent with
this article is hereby repealed to the extent of such conflict.
This article shall be effective upon adoption.
