Section 215.330 Kennels.

The owning and/or operation of a kennel, within the City limits of the City of Overland, is prohibited except in conformance with the provisions set forth in Chapter 660: Kennels.

Section 215.340 Dog Park Areas.

A. Notwithstanding Section 215.180, the City Council may designate an area of City property for off-leash dog use if the City Council determines that there is a need for such an area and it will be maintained so as not to create a nuisance. The area shall be known as a "dog park area."

B. The City Council hereby designates the area known as the "Woodson Road Dog Park" as a "dog park area."

C. The Director of Parks and Recreation is hereby authorized and directed to establish such rules and regulations deemed necessary to properly maintain and/or operate the dog park areas, and to assure the safety of dog park area users and the general public. Said rules and regulations shall be posted in such a manner as to be visible to all users of the dog park area.

D. Only dogs, meeting the following requirements, shall be permitted to use the dog park area:

1. Immunizations must be up to date, and

2. Dog must be spayed/neutered, and

3. Owner has obtained separate license, issued by the City, to use the dog park.

E. The City shall issue a separate tag, in addition to the tag required by Sections 215.150 through 215.170, indicating that the dog is permitted to use the dog park area.

F. The annual license fee for a resident to use the dog play area shall be twenty-five dollars ($25.00) for the first dog and ten dollars ($10.00) for each additional dog, which shall be in addition to the annual dog license fee required by Section 215.150.

G. The annual license fee for a non-resident to use the dog play area shall be thirty-five dollars ($35.00) for the first dog and ten dollars ($10.00) for each additional dog. The provisions of Sections 215.150 through 215.170 shall also apply to non-residents, except for the annual fee imposed on residents. The dog tag issued to the applicant and worn by the dog as required by Section 215.170 and this Section shall indicate that the dog is permitted to use the dog park area.

H. The City Council may limit the number of non-resident dog licenses issued in order to ensure the health, safety and welfare of dog park area users and the general public.

I. Dangerous dogs, as defined within this Chapter, are prohibited from use of any dog play area and dog park area as designated by the City Council in accordance with this Section.

J. The City Council may enter into an agreement with a person to operate, manage or maintain a dog park area and compensate such person in an amount not to exceed the total annual license fees paid to the City to use the dog park area.
