There is hereby created, pursuant to Sections 89.070 and 89.310,
RSMo., 1939, a Planning and Zoning Commission for the City which shall
consist of seven (7) members to include the following:
The Mayor, a member of the Board of Aldermen selected by the
Board of Aldermen, the City Engineer or similar City Official and
four (4) citizens appointed by the Mayor and approved by the Board.

The term of each of the citizen members shall be for four (4)
years, except that the terms of the citizen members first appointed
shall be for varying periods so that succeeding terms will be staggered.
Of the initial four (4) citizen members, one (1) shall serve for a
period of one (1) year, one (1) shall serve for a period of two (2)
years, one (1) shall serve for a period of three (3) years, and one
(1) shall serve for a period of four (4) years. All citizen members
of the Commission shall serve without compensation.

Immediately following their appointment, the members of the
Planning and Zoning Commission shall meet, organize, elect such officers
as it may deem necessary, to include a Chairman and Secretary from
among the citizen members, and adopt and later change or alter, rules
and regulations of organization and procedure consistent with City
ordinances and State laws. The Commission shall keep written records
of its proceedings, which shall be open at all times to public inspection.

A. The
Planning and Zoning Commission shall have the following powers and
duties:
1. To prepare and recommend to the Board of Aldermen, a Comprehensive
Plan of public improvement, looking to the present and future development
and growth of the City. Such a plan after its adoption by the Board
of Aldermen will be known as the Official Plan. Such plan may include,
among other things, the general location, character and extent of
streets and other public ways, grounds, places and streets; the general
location and extent of public utilities and terminals, whether publicly
or privately owned, the acceptance, widening, removal, extension,
relocation, narrowing, vacation, abandonment or change of use of any
of the foregoing.
2. To prepare and recommend to the Board of Aldermen from time to time,
such changes in the plan or any part thereof, as may be deemed necessary
by the Board of Aldermen or by the Commission.
3. To prepare and recommend to the Board of Aldermen from time to time
plans, and/or recommendations for specific improvements in pursuance
of such Official Plan.
4. To prepare and recommend to the Board of Aldermen from time to time,
an ordinance or code regulating and restricting the height, number
of stories, and size of buildings and other structures, the percentage
of lot that may be occupied, the size of yards, courts and other open
spaces, the density of population, the preservation of features of
historical significance, and the location and use of buildings, structures
and land for trade, industry residence or other purposes.
5. To prepare and recommend to the Board of Aldermen from time to time,
regulations designed to lessen congestion in the streets; to secure
safety from fire, panic and other dangers; to promote health and the
general welfare; to provide adequate light and air; to prevent the
overcrowding of land; to avoid undue concentration of population;
to preserve features of historical significance; to facilitate the
adequate provision of transportation, water, sewerage, schools, parks
and other public requirements. Such regulations shall be made with
reasonable consideration, among other things, to the character of
the district and its peculiar suitability for particular uses, and
with a view to conserving the values of buildings and encouraging
the most appropriate use of land throughout the City of New London.
6. To prepare and recommend to the Board of Aldermen from time to time,
the boundaries of the various original districts and appropriate regulations
to be enforced within each said district.
7. To give aid to the City Officials, charged with the direction of
projects for improvements, embraced within the Official Plan, to further
the making of such improvements, and generally to promote the realization
of the Official Plan.
8. To arrange and conduct any form of publicity relative to its activities
for the general purpose of public understanding.
9. To cooperate with municipal or regional planning commissions and
other agencies or groups to further the local planning program and
to assure harmonious and integrated planning for the area.
10. To exercise such other powers germane to the powers granted by Statute.

Following the adoption of an Official Plan, no map or plat of
any subdivision presented for record, affecting land within the corporate
limits of the City, shall be entitled to record or shall be valid
unless the subdivision thereon shall provide for streets, alleys,
and public grounds in conformity with requirements applicable thereto
of such Official Plan and as provided for in the Zoning Regulations
passed upon by the Board of Aldermen.

The Commission may at the discretion of the Board of Aldermen
employ necessary help whose salaries, wages, and other necessary expenses
shall be provided for by adequate appropriation by the Board of Aldermen.
