The right, permission and authority be, and the same are hereby granted to the Missouri Power and Light Company, a corporation duly organized and existing under the laws of the State of Missouri, hereinafter designated as "power company", to construct, maintain and operate a system of mains, pipes, services and other appliances for the transmission, distribution and sale of natural and/or artificial gas for lighting, heating, industrial and other uses, in the City of New London, a municipal corporation organized and existing under and by virtue of the laws of the State of Missouri. The power company may construct, maintain and operate all mains, pipes and other appliances necessary or convenient for such system in, upon, over, across, along, and under each and all of the streets, avenues, alleys, bridges, and other public places, including any subsequent additions thereto, in accordance with the ordinances and regulations currently in force in the City of New London.

All mains, pipes, services, and appurtenances erected, installed or placed under this grant shall be located on streets or alleys wherever practicable so to do and shall be installed and placed under the supervision of the committee on streets and alleys of said City of New London or under such supervision as said City of New London may from time to time provide; and where the paving or surfacing of the street or alley is disturbed, the power company shall, at its own expense and in a manner satisfactory to the duly authorized representatives of the City of New London, replace such paving or surfacing of the street or alley in as good a condition as before said work was commenced. In the installation or placing of mains, pipes, services or appurtenances, the power company shall make application to the City of New London for the establishment of permanent grades; and such mains, pipes, services and appurtenances shall be installed only after such permanent grades have been established. The City of New London agrees to establish promptly such permanent grades on such application.

The rates to be charged by the power company under this Chapter shall be in accordance with those now or hereafter filed with and approved by the Missouri Public Service Commission or its legally qualified successor.

The power company shall maintain adequate and continuous service to the inhabitants of the said City of New London, in accordance with its rules and regulations on file with the Missouri Public Service Commission subject, however, to temporary cessations of service occasioned by fire, explosion, flood, strike, insurrection, mob violence, governmental interference, breakdown or injury to equipment or lines, or other accidents or causes not reasonably within the control of said power company.

All rights and privileges granted by this Chapter are granted for a term of twenty (20) years from and after the acceptance of this Chapter.

The Mayor of the City of New London is authorized and directed to execute for and on behalf of the City of New London a contract with the Missouri Power and Light Company for the lighting of public streets. The contract referred to is expressly set out in ordinance no. 201 which is on file in the City offices.

The City of New London, in order to maintain its source of revenue at its historical level, hereby determines to maintain the five percent (5%) gross receipt tax against all persons, firms or companies engaged in the business of supplying gas for compensation in the City of New London, Missouri.

The City of New London, in order to maintain its source of revenue at its historical level, hereby determines to maintain the four and forty-eight hundredths percent (4.48%) gross receipt tax against all persons, firms or companies engaged in the business of supplying electricity for compensation in the City of New London, Missouri.
