A Waterworks Department for the City of New London, Missouri, is hereby established. All accounts of said Department shall be kept separate from any other accounts of the City.

All charges for water service shall be established on meter readings and collected against each lot, parcel of land or premises to which water is supplied by the City Waterworks Department. Whenever for any cause a water meter fails to operate, a reasonable estimate shall be made by the Water Superintendent of the amount of water supplied during the period such meter fails to operate and the user shall pay a rate based on the whole or part of the estimated amount of water supplied.

The monthly rate schedule shall be as follows: Effective from the passage of this Section until January 1, 2015, two thousand (2,000) gallons per month or less shall be nineteen dollars ($19.00); all usage over two thousand (2,000) gallons shall be charged at the rate of nine dollars fifty cents ($9.50) per one thousand (1,000) gallons, to be determined to the nearest one hundred (100) gallons. Agricultural bulk users shall pay at the rate of nine dollars fifty cents ($9.50) per one thousand (1,000) gallons figured to the nearest one hundred (100) gallons.

Effective October 1, 2018, the monthly rate schedule shall be as follows: two thousand (2,000) gallons per month or less shall be twenty-one dollars and fifty cents ($21.50); all usage over two thousand (2,000) gallons shall be charged at the rate of ten dollars and seventy-five cents ($10.75) per one thousand (1,000) gallons, to be determined to the nearest one hundred (100) gallons. Agricultural bulk users shall pay at the rate of ten dollars and seventy-five cents ($10.75) per one thousand (1,000) gallons figured to the nearest one hundred (100) gallons.

Bills for rates and charges herein established should be made out and mailed by the City Clerk on a monthly basis. The bills shall be payable by the fifteenth (15th) of the month following the reading of the water meters. All bills shall be payable at the office of the City Clerk.

If any charge called for in this Article is not paid by the fifteenth (15th) of the month in which it shall become due and payable a delayed payment charge of ten percent (10%) of the amount of the bill shall be added thereto and collected therewith.

Charges for water service and for wastewater disposal service shall be united on the same bill and payment of one (1) charge shall not be accepted without payment of the other charge.

Whenever any new user shall be connected with the City waterworks system, a deposit of one hundred dollars ($100.00) shall be made. This deposit shall be held by the City of New London and shall be applied to the payment of any bill not paid by the 30th day of the month in which it is due. When water service shall be disconnected, the amount of such deposit, less the amount applied to payment of charges, shall be returned to the depositor without interest; provided, however, that if after two (2) years the user has shown a satisfactory payment record, the City may, upon request of the user, refund the deposit. If any bills for services of the waterworks system shall remain unpaid after the 25th day of the month in which it is due, the water supply for the lot, parcel of land or premises affected shall be cut off and shall not be again turned on except on payment in full of the delinquent charges therefor, and a reconnect charge of twenty-five dollars ($25.00).

The owner of any lot, parcel of land or premises receiving any services of the waterworks system of the City, and the occupant of such premises shall be jointly and severally liable for the payment of services to such lot, parcel of land or premises. The rendering of such services by the City of New London to any such premises is conditioned on such owner and occupant being jointly and severally liable therefor to the City of New London.

Whenever any lot, parcel of land or premises, after September 4, 1990, shall become connected to the waterworks system of the City, the customer shall be fully responsible for all costs involved in the hook-up of the said lot, parcel of land, or premises, to the City water main. The customer is also responsible for insuring that City property and right-of-ways are put back in the same or substantially the same condition as they were in prior to the customer's waterline placement. Prior to any connection of any lot, parcel of land, or premises to the City water main, the customer must obtain a permit from the City Clerk's office after depositing a bond payable to the City in the amount of five dollars ($5.00) per linear foot of City pavement and one dollar ($1.00) per linear foot of City right-of-way which is to be disturbed in the placement of the customer's waterline. After a one (1) year period has expired from the date of the depositing of this bond, if the replacement work done to the City property and right-of-ways is deemed adequate by the City Water Superintendent, seventy-five percent (75%) of the said bond shall be returned to the customer. The remaining twenty-five percent (25%) of the bond deposited by the customer shall be returned by the City for any necessary future repairs to said property.

Whenever a lot, parcel of land or premises after September 4, 1990, shall become connected to the waterworks system of the City, the one-hundred-fifty-dollar ($150.00) hookup charge for water connection must be paid prior to the water service being completed and accepted by the City. Said fee is to defray the costs of connection service. An additional fee, equal to the amount paid by the City of New London for any additional parts required for hookup to the City water main, shall also be paid before any lot, parcel of land or premises shall be connected to the water service of the City.

A charge of five dollars ($5.00) shall be made for shutting off and turning on water services, except at the time of commencement of such service or at the termination.
