There is hereby created a Fire Department for the City, to be composed of a Fire Chief and twenty (20) Firemen, chosen as hereinafter designated.

At the first (1st) regular meeting of the Board in May, the Board shall elect some suitable and qualified person, between the ages of twenty-one (21) and seventy (70) years, as Fire Chief, who shall serve for a term of one (1) year, unless sooner removed. In the event of a vacancy in the office of the Fire Chief, Assistant Fire Chief shall serve until the next regular meeting of the Board, at which time the vacancy shall be filled by election of the Board, the person so elected to serve the unexpired term.

Immediately upon his/her election, the Fire Chief shall recommend to the Board twenty-five (25) persons, possessing the general qualifications required for other officers of the City, between the age of eighteen (18) years of age and seventy (70) years, to serve as members of the Fire Department. Five (5) of these persons are to be available to serve from 7:00 A.M. — 3:00 P.M. The members of the Department shall be chosen from among volunteers and, upon their approval by the Board, shall serve until removed or voluntary withdrawal. Vacancies shall be filled in the same manner.

For the performance of the duties herein required, the Firemen shall receive a sum as set by ordinance from time to time.

Every person duly selected as a member of the Fire Department shall be subject to call at any time of day or night, to attend any fire within the City; and if any member shall fail, neglect or refuse to attend any fire without reasonable cause therefor, he/she shall be subject to immediate removal from the Department. Members shall be called to attend fires by the sounding of the fire alarm, and upon the sounding thereof they shall assemble, as quickly as possible at the station house or other place designated by the Fire Chief.

In the absence of the Chief, the Assistant Chief shall be in full charge and control of the Department, and the exercise of all the powers and duties herein specified for the Chief.

All members of the Fire Department shall perform such duties as may be required of them by the Chief, and shall obey such other rules and regulations as may be prescribed by the Board of Aldermen.

The Fire Chief shall be responsible for the discipline, good order and conduct of the Department, the enforcement of all laws, ordinances and regulations pertaining thereto, and for the care and condition of the houses, engines, the trucks, and all other property of the Department. He/she shall have the superintendence, control, and command of all the men belonging to the Department, of all the engine houses and all houses used for that purpose, and, of all engines and fire apparatus belonging to the City. He/she shall likewise have control of all persons present at the fire scene. He/she shall have power, if need be, to summon any and all persons present to aid in extinguishing a fire, and any person so summoned and aiding shall be entitled to a reasonable compensation therefor, as recommended by the Chief and allowed by the Board. He/she shall, when a fire breaks out, take immediate and proper measures for its extinguishment. He/she shall have the right to remove personal property from any building on fire, or in danger thereof, and to guard the same. Any person refusing to obey the commands of the Chief, while present at a fire, shall be deemed guilty of a misdemeanor. The Chief shall have the power to order the cutting down and removing of any building, erection, fence or other thing, if he/she deems it necessary for the purpose of checking a fire in its progress. In case of absence of the Chief from any fire, the Assistant Chief shall, for the time, have all the powers of the Chief and perform the duties of that office. The Chief may prescribe limits in the vicinity of a fire, within which no person, except members of the Fire or Police Department, and those admitted by order of the Chief or his/her Assistant, shall be permitted to come.

The Chief and the Committee of the Board of Aldermen on the Fire Department shall adopt and promulgate rules and regulations for the conduct of the Fire Department, and the Chief and the Committee shall have authority peremptorily to suspend or discharge any Fireman for neglect of duty or disobedience of order.

A. 
The Chief shall keep, in suitable books, a record of the names, ages and residences of all of the members of the Fire Department, the time of their admission and discharge and an inventory of all the property belonging to the Department.
B. 
The Chief shall also keep a record of every fire that may occur, showing what property was destroyed, giving its description, name of owner, and occupant, where situated, its value, the amount of loss and insurance.
C. 
The Chief shall also keep a record of false alarms, of the cause of various fires, of the expense connected with the Department, and of such other facts as he/she may deem of value to be preserved, and report the same to the Board at its first (1st) meeting in each month.

At the close of each fiscal year the Chief shall report to the Board a summary of the record kept during the year.

A. 
A certain document, a copy of which is on file in the office of the City Clerk of the City of Seneca, being marked and designated as "The BOCA National Fire Prevention Code, Tenth Edition, 1996", as published by the Building Officials and Code Administrators International, Inc. is hereby adopted as the Fire Prevention Code of the City of Seneca, in the State of Missouri; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Fire Prevention Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Article, with the amendments set forth in Subsection (B) hereof.
B. 
Amendments, Changes And Deletions.
Section F-101.1 Insert City of Seneca.
Chapter 31 is hereby deleted in its entirety.
Any person violating any of the provisions of this Article or the Code adopted in this Article shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned in the County Jail for a period of not exceeding ninety (90) days, or both such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
