It shall be unlawful for any person to conduct, advertise or participate in any garage sale or yard sale in any "R-1", "R-2" or Mobile Home Residential District on more than two (2) occasions within any one (1) calendar year and on the same premises.

Whenever used herein these terms shall have the following meanings:
GARAGE SALE AND YARD SALE
All sales entitled garage sale, yard sale, lawn sale, attic sale, rummage sale, flea market sale, or any other similar casual sale by which tangible personal property is occasionally offered for sale to the public in a residential area.
OCCASION
The actual length of time for the sale or a maximum of three (3) continuous days.
PERSON
Individuals, partnerships, voluntary associations and corporations.

A. 
The provisions of this Chapter shall not apply to affect the following persons or sales:
1. 
Persons acting in accordance with the powers and duties as public officials or by order or process of a court of competent jurisdiction.
2. 
Any persons selling or advertising for sale any item or items of personal property which are specifically named or described in an advertisement and which separate items do not exceed three (3) in number.
3. 
Public auctions.

Any person conducting a sale which is described in Section 615.010 shall first obtain a permit from the City Clerk, for which there will be no charge.

It shall be the duty and obligation of any person or persons conducting such yard or garage sales to remove all articles and goods offered for sale as well as all signs concerning same from the public view by 9:00 P.M. on the last day such sale is held.

Any person conducting any such sale in violation of this Chapter shall upon conviction be fined not less than five dollars ($5.00) or more than five hundred dollars ($500.00) or be imprisoned for a period not to exceed ten (10) days for each violation hereof.
