The City of Clairton hereby elects to enroll its police officers in the Pennsylvania Municipal Retirement System, established by the Pennsylvania Municipal Retirement Law, Act 15 of 1974, as amended, 53 P.S. § 881.101 et seq. (the "Law"), with the express purpose of having the Pennsylvania Municipal Retirement System administer the retirement plan established by the City for its police officers. The City of Clairton does hereby agree to be bound by all the requirements and provisions of Article IV[1] and the Law, as the case may be, and to assume all obligations, financial and otherwise, placed upon member municipalities by the Law. All references hereafter shall be based on benefits negotiated between the Board and the City under the provisions of Article IV.

Membership in the Pennsylvania Municipal Retirement System shall be mandatory for all full-time police officers of the City. Membership for elected officials and employees hired on a temporary or seasonal basis is prohibited, as is membership for individuals paid only on a fee basis.
Credit for prior service for original employees is granted for each year or partial year thereof that the member was employed by the City from his or her original date of hire. Benefits provided to members in the agreement dated October 8, 1991, shall accrue based on all credited service granted and earned in accordance with this section.
Payment for any obligation established by the adoption of this article and the agreement between the System and the City of Clairton shall be made by the City in accordance with the Pennsylvania Municipal Retirement Law and Act 205 of 1984, the Municipal Pension Plan Funding Standard and Recovery Act.[1]

As part of this article, the City agrees that the System shall provide the benefits set forth in the agreement between the Board and the City of Clairton, dated October 8, 1991. The passage and adoption of this article by the City of Clairton is an official acceptance of said agreement and the financial obligations resulting from the administration of said benefit package. The City of Clairton hereby assumes all liability for any unfundedness created due to the acceptance of the benefit structure outlined in the above-referenced agreement.
By adoption of this article, the City agrees to terminate, upon the effective date of membership in the Pennsylvania Municipal Retirement System, any previously maintained City pension program applicable to those employees identified as members in § 79-2 of this article and to transfer any assets from any existing plan to offset the established liability. It is the intent of the City to have the Pennsylvania Municipal Retirement System also assume administration of all assets and liabilities associated with the retirees and their beneficiaries of the City's previously maintained Police Pension Plan. The City of Clairton also hereby acknowledges that an affirmative vote representing at least 75% of the previous plan members indicated that the members were in agreement with the establishment of the plan with the Pennsylvania Municipal Retirement System.
A duly certified copy of this article and the referenced agreement[1] shall be filed with the Pennsylvania Municipal Retirement System of the Commonwealth of Pennsylvania. Membership for the police officers of the City of Clairton in the Pennsylvania Municipal Retirement System shall be effective the first day of November 1991.
