This article shall be known as "A Local Law Authorizing the Enforcement of the Provisions of Dutchess County E 911 Sign Laws."
This article is enacted pursuant to the authority granted to the Town by § 10 of the Municipal Home Rule Law of the State of New York.
A. 
A. The Dutchess County Legislature previously determined that it was in the best interests of the citizens of the County of Dutchess to have uniform signs for E 911 purposes so that all structures in the County can be easily identified by emergency vehicles. In addition, the Dutchess County Legislature strongly felt that each citizen had the responsibility of affixing his or her E 911 number once that number has been received and that there must be cooperation among the citizens, the government and the emergency service providers in order for the E 911 system to operate as designed. In furtherance of these intents and purposes, the Dutchess County Legislature enacted Local Law No. 8 of the year 1999 titled "A Local Law Establishing a Sign Law for E 9-1-1 Purposes." The Dutchess County Legislature thereafter enacted Local Law No. 8 of 2000 titled "A Local Law Amending Local Law No. 8 of 1999." These two County local laws are hereby referred to in this article collectively as "The Dutchess County E 911 Sign Law." The Dutchess County E 911 Sign Law, in relevant part:
(1) 
Established requirements for the numbering of houses and structures for E 911 purposes;
(2) 
Established road name sign standards for E 911 purposes;
(3) 
Established procedures to be followed upon noncompliance of said requirements;
(4) 
Established penalties for offenses of said E 911 Sign Law;
(5) 
Established an appeal process and an appeals panel to hear and determine appeals from official determinations with regard to said Dutchess County E 911 Sign Law; and
(6) 
Established provisions for enforcement of said law, including the exaction of fines for violations of said law and the levying of delinquencies for payment of said fines on property tax bills.
B. 
The Dutchess County E 911 Sign Law also provided, in relevant part, that any city, town or village in Dutchess County may authorize the enforcement of the provisions of the said Sign Law by designating by appointment of an enforcement official for the service of notices, issuance of summonses, prosecution of violations and collection of fines therein. The said Dutchess County E 911 Sign Law also provides, in relevant part, that where any city, town or village within the County of Dutchess has enacted a local law authorizing the enforcement of the provisions of the Dutchess County Sign Law, the designated officer of such municipality may notify the governing board of said municipality of any delinquencies in the payment of the fines for purpose of levying the same with the next property tax bill.
C. 
The Town Board of Rhinebeck has determined that it is in the best interests of the health, safety and welfare of the citizens of the Town for the Town to authorize the enforcement of the Dutchess County E 911 Sign Law.
A. 
The Town Board of Rhinebeck hereby authorizes the enforcement of the provisions of Local Law No. 8 of 1999 and Local Law No. 8 of 2000 of Dutchess County as and as may be amended hereinafter by the Dutchess County Legislature enacted (hereby known collectively as "The Dutchess County E 911 Sign Law"), within the Town of Rhinebeck.
B. 
The Town Board of Rhinebeck hereby designates by appointment the Town's Code Enforcement Officer as the official for service of all notices, issuance of summonses, prosecution of violations and collection of fines, as set forth in the Dutchess County E 911 Sign Law.
C. 
The Town Board of Rhinebeck hereby authorizes the enforcement of all provisions of the Dutchess County E 911 Sign Law by the Town's Code Enforcement Officer and incorporates all provisions of said Dutchess County E 911 Sign Law as presently exists, and as may be amended in the future.
D. 
The provisions of the Dutchess County E 911 Sign Law shall apply to all homes, businesses and properties within the Town of Rhinebeck except that:
(1) 
All road address numbers for residences, as set forth in said Dutchess County E 911 Sign Law shall be not less than four inches in height rather three inches in height as set forth in said Dutchess County E 911 law;
(2) 
All buildings shall have address numbers placed in a position to be plainly visible from the street. The numbers shall have a minimum stroke of 1/2 inch, as required by the New York State Uniform Fire Prevention and Building Code;
(3) 
If a building is more than 50 feet from the road, and if a mailbox is used to mark the address, the mailbox must be adjacent to the driveway and not across the street, or, alternatively, if the mailbox is across the street, a number must be posted adjacent to the driveway; and
(4) 
If a driveway serves more than one numbered building, there must be markers at any fork or branch in the driveway to indicate which numbers can be reached on each branch.
E. 
All fines levied pursuant to this article shall be paid to the Town Clerk of the Town of Rhinebeck and shall be retained by the Town of Rhinebeck for general purposes.
F. 
In the event of a failure of a property owner to pay any fine levied pursuant to the Dutchess County E 911 Sign Law within the time period specified in the Dutchess County E 911 Sign Law, the Code Enforcement Officer may notify the Town Board of said delinquencies, and the Town Board shall take the necessary steps for levying said delinquencies on the next tax bill for the said property in accordance with the provisions of the Dutchess County E 911 Sign Law.
G. 
Copies of the Dutchess County E 911 Sign Law, as currently exists, and as may be amended in the future, shall be kept on file in the Town Clerk's office and shall be available for inspection and copying during normal business hours and a copy of this article and the Dutchess County E 911 Sign Law shall be posted on the Town's official website.
The invalidity of any provision of this article shall not affect the validity of any other provision of this article which may be given effect without such invalid provision.
This article shall take effect 90 days after filing in the Office of the New York State Secretary of State in accordance with § 27 of the Municipal Home Rule Law.
