The Borough Council of the Borough of Darby, pursuant to the authority contained in the Borough Code,[1] as may be amended from time to time, finds and declares the need for a Health Board to operate within the territorial limits of the Borough, and authorizes, creates and establishes Borough of Darby Health Board.

A. 
The Health Board shall enforce the laws of the Commonwealth of Pennsylvania, the regulations of the State Department of Health, and all ordinances of the Borough enacted to prevent the introduction and spread of infectious or contagious disease; abate and remove all nuisances which the Board shall deem prejudicial to the public health; mark infected houses; recommend rules for the construction and maintenance of house drains, wash pipes, soil pipes and cesspools; and, recommend all such other rules and regulations as shall be deemed necessary for the preservation of the public health. Such rules and regulations shall not become effective until Borough Council approves them and enacts them as ordinances of the Borough.
B. 
The Board shall recommend to Borough Council all necessary rules and regulations not inconsistent with law for carrying into effect the powers and functions with which law invest the Board and the power and authority relating to public health conferred on boroughs. Such rules and regulations shall not become effective until Borough Council approves them and enacts them as ordinances of the Borough.
C. 
The Board shall research, recommend, pursue and offer assistance in obtaining all necessary and appropriate grants and financing to carry out its functions as provided by law.
D. 
The Board may exercise all powers provided it by the laws of the Commonwealth of Pennsylvania and the ordinances and resolutions of the Borough of Darby.
E. 
The Board shall report monthly to the Borough Council's Ordinance Committee.
A. 
The Board shall be composed of five members, which the Borough Council shall appoint. At least one of the Board members shall be a reputable physician of not less than two years' experience in the practice of his profession. The resumes evidencing the qualifications of the physician shall be filed with the Borough Secretary. In the event a licensed physician who is also a resident of and/or maintains a practice of medicine within the Borough of Darby cannot be appointed to serve or is unwilling to serve on the Board, Council may appoint a licensed physician from outside the Borough but who otherwise meets the qualifications to serve on the Board. The remaining members of the Board shall be residents of the Borough of Darby.
B. 
The terms of the Board's first members shall be so fixed that no more than one member shall be replaced or reappointed during any one calendar year. Their successors shall serve for a term of five years.
C. 
All members of the Board shall serve without compensation.
D. 
The Board shall elect its own Chairman, and may elect, in such manner as it determines, other necessary officers. The office of Chairman, and any other offices, shall have a term of one year, and the Board shall reorganize annually.
