The purpose of this chapter is to eliminate insects, rodents
and other pests from any building, lot or premises in the Borough
of Darby. The Code Enforcement Officer of the Borough of Darby is
hereby directed to enforce the provisions of this chapter.
As used in this chapter, the following terms shall have the
meanings indicated:
ERADICATION
The elimination of rodents or insects and any other pest
life from any building, lot or premises through the use of traps,
baiting, fumigation or any other method of extermination approved
by the Borough, subject to applicable laws relating to poisonous substances
and fumigants.
HARBORAGE
Any condition which provides shelter or protection for rodents,
insects or other pest life.
PERSON IN CONTROL
The owner or part owner of a building, lot or premises, whether
an individual, partnership or corporation, or the agent or representative
of a building, lot or premises.
RODENTPROOFING
The treatment or shielding, with material impervious to rodent
gnawing, of all actual or potential openings in the exterior and interior
walls, ground or first floors, roofs, foundations, basements, sidewalks,
gratings and other places that may be reached by rodents from the
ground or by climbing or burrowing.
All buildings, lots or premises in this Borough shall be kept
free from any condition conducive to rodents, insects and other pest
life. The person in control shall not allow the accumulation of water,
garbage, building material, brush, woodpiles and any other material
which may afford harborage or provide food for rodents, insects or
other pest life.
If, after inspection by the Code Enforcement Officer of the
Borough of Darby, it is determined that there is a violation of the
provisions of this chapter, the person who owns, occupies or is in
control and in charge of the premises shall be given written notice
by personal service or certified mail, return receipt requested, by
the Code Enforcement Officer, that the person is in violation of the
said chapter. Such person shall, within 10 days after being so notified,
make the necessary changes in the premises, lot or building to eliminate
the violation and shall further take the necessary eradication measures
in order to eliminate and exterminate the rodents, insects and other
pests.
Any person who shall violate any provisions of this chapter
shall, upon conviction thereof, be punishable by a fine of not more
than $300 and costs of such proceedings or, upon default of payment
of such fines and costs, by imprisonment in the county jail for a
term of not more than 30 days. The continuation of such violation
for each successive day shall constitute a separate offense, and the
person or persons allowing or permitting the continuation of the violation
may be punished as provided above for each separate offense.
