A. 
The Common Council finds that peacefulness and quiet at late-night hours promote and protect the health, safety and welfare of the citizenry and that encouraging peacefulness and quiet at late-night hours is, therefore, desirable and in the best interest of the citizenry of the City of Peekskill. The Common Council further finds that certain types of business establishments in certain areas of the City are open for business at unnecessary and inappropriate times, encouraging people to congregate in publicly owned or publicly accessible areas in and around those establishments, resulting in loud, noisy and sometimes disorderly behavior in conflict with the goal of the City to promote peacefulness and quiet at late-night hours.
B. 
By limiting the hours of operation of certain businesses within certain areas of the City, it is the purpose of this article to provide a peaceful, quiet, enjoyable environment late at night for the residents of the City and the public at large while allowing for businesses to thrive and prosper by providing a reasonable opportunity for the public to patronize them, in order to improve business and economic opportunities as well as the quality of life in those areas.
The following terms shall have the following meanings for the purposes of this article:
FAST-FOOD ESTABLISHMENT
Any eating or drinking establishment or any establishment which sells primarily food products and beverages where the majority of services is available from an over-the-counter-type installation or in which there is no waiter or waitress service, whether or not interior seating facilities are provided. This shall include, but shall not be limited to, delicatessens or delis and other food service establishments but shall not include restaurants as defined in this section.
LIMITED HOURS OF OPERATION DISTRICT
The area bounded by and including Main Street eastward from Route 9 to Hadden Street; Hadden Street northward from Main Street to Belden Street; Belden/Paulding Street eastward to Nelson Avenue; Nelson Avenue northward to Phoenix Avenue; Phoenix Avenue eastward to North Division Street; North Division Street southward to Orchard Street; Orchard Street eastward to North Broad Street; North Broad Street southward to Main Street; Main Street eastward from North Broad Street to Grant Avenue; Grant Avenue southward from Main Street to Park Street; Park Street westward from Grant Avenue to South Division Street; South Division Street southward from Park Street to South Street; South Street westward from South Division Street to Route 9; and Route 9 northward from South Street to Main Street, and each and every street, avenue or way within that area, including but not limited to the portions of the following streets contained within that area; Decatur Avenue, John Street, Nelson Avenue, Union Avenue, Main Street, North Division Street, South Division Street, James Street, North Broad Street, South Broad Street, Sparrow Lane, Field Street, Charles Street, Southard Avenue, Central Avenue, Washington Street and Armstrong Avenue.

RESTAURANT
Any premises where food and beverages are commercially sold primarily for on-premises consumption by patrons seated at tables and served by wait staff.
No fast-food establishment within or located on any street, avenue or way within the limited hours of operation district shall be open for business to the public between the hours of 11:00 p.m. and 6:00 a.m. on any day.

In the M-2A Design Industrial District, no outdoor business or operations of any kind shall be conducted between the hours of 7:00 p.m. and 6:00 a.m. on any day.

A violation of any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not more than $250 or imprisonment for not more than 15 days, or both, for each offense.
