For the purpose of this chapter, the following terms shall have the meaning indicated:
GUN RANGE
A place wherein shotguns of any kind or description are used for exploding cartridges or projecting shot or missiles of any kind.
It shall be unlawful for any person, firm or corporation to open, operate or maintain, or cause to be opened, operated or maintained, any gun range as hereinbefore defined without first obtaining a license to do as hereinafter provided.
A. 
Application for a license to operate and maintain a gun range shall be filed with the Township Clerk on forms to be provided.
B. 
Such application shall contain the name and address of the applicant; and if a corporation, the full and accurate corporate name, where and when incorporated, principal place of business, name and address of the resident agent and all corporate officers; and if a partnership, the names and addresses of the members thereof; and if applicant conducts business under a trade or assumed name, the full and complete trade name and the name and address of the person or persons doing business under such name.
C. 
Such application shall recite the present or proposed location of the gun range and have attached thereto a full and complete plan and description for construction, and for controlling shot or missiles, and such other information as this chapter, the Township Board or its duly authorized agents and employees may require.
The application shall be referred to the Building Official and/or ordinance enforcement officer, who shall make or cause to be made an investigation of the character of the applicant and of the fitness and suitability of the gun range from the standpoint of public safety and compliance with the regulations hereinafter set forth. Upon completion of such investigation, the Building Official and/or ordinance enforcement officer shall present said application, plans, and other documents to the Township Board with their recommendations.
Upon receipt of the application from the Building Official and/or ordinance enforcement officer, with their recommendations, the Township Board shall approve or reject said application or take such other action as shall be appropriate. In the event the license is granted, the Township Clerk shall issue same upon the payment of a fee of $100 per year for each gun range to be operated. All such licenses shall be for a period of one year and shall expire on the 31st of December next following the date of issuance. The license shall be renewed annually thereafter, upon the recommendation of the Building Official and/or ordinance enforcement officer after an investigation to determine that there is continuing compliance with this chapter and all other ordinances, codes and regulations of the Township of Huron. The license shall be conspicuously exhibited upon the premises licensed thereunder.
No license shall be issued by the Township Clerk until the applicant shall deposit a policy or certificate of liability insurance acceptable to and approved by the Township Attorney, insuring and indemnifying the applicant against injuries and death to persons and property resulting from the operation of said gun range. Said policy shall further contain a clause obligating the insurance company issuing same to give 30 days' written notice to the Township Clerk before cancellation of the same. In case said policy of insurance is canceled and not replaced, the license shall forthwith be canceled at the expiration of said thirty-day period.
All gun ranges shall comply with the following regulations:
A. 
The firing point shall be so constructed as to prevent any shotgun from being pointed at an elevation or in a direction that would carry the shot or other missile beyond the shotgun range.
B. 
The area in which the gun target area is located shall be no closer than 300 feet from the property line of the licensee.
C. 
No owner, operator or attendant shall permit any person under the influence of intoxicants or narcotics to handle or discharge any of the aforementioned firearms.
D. 
No persons shall be allowed between the firing point and the target area when the range is in operation, and the licensee shall construct such fences, barriers or invisible markers as in the opinion of the Building Department will adequately prevent persons from accidentally straying thereon.
E. 
The gun range shall be attended at all times by the licensee or his employees so as to adequately supervise the range.
F. 
Shooting shall be permitted only between the hours of 10:00 a.m. and 6:00 p.m. on Wednesday, Friday, Saturday and Sunday and shall not be permitted at any other time.
G. 
In addition to the foregoing, the Township Board is hereby empowered to make such further regulations not inconsistent herewith which may from time to time be required for the protection of the public safety and welfare.
The Township Board may at any time revoke or suspend the license granted under this chapter for failure to comply with the terms of this chapter or any of the laws or regulations relating to the use of gun ranges.
Any person, firm or corporation violating any of the provisions of this chapter shall upon conviction be fined in an amount not to exceed $500 or imprisoned for a term not to exceed 90 days, or both.
