There is established in the Town a board to be known as the Park Board which shall consist of nine (9) members, all of whom shall be citizens of the Town and who have resided within said Town for a period of at least one (1) year next before their appointment and no member of the municipal government shall be a member of the Board.

That the members of the Board of Directors shall be a politically non-partisan board appointed by the Council of the Town of Carrollton; they shall hold office for a term of three (3) years each, or until their successors are appointed and qualified; with each member given the privilege of re-appointment subject to the approval of the Town Council for a consecutive three-year term. Thereafter, that person shall not serve until the expiration of a period of three (3) years whereupon said person may be re-appointed to the Board. The Council may remove any director for misconduct or negligence of duty.

Any member of said Park Board who shall accept the nomination or appointment for any political office during his/her official term as member of said Board, shall be deemed thereby to have resigned as a member of said Board, and his/her membership shall thereby be ipso facto vacated.

Vacancies in the Board of Directors occasioned by removal, resignation, death or otherwise, shall be reported to the Council and be filled in like manner as original appointments. Any person appointed by the Council to fill a vacancy shall hold office for the remainder of the term to which his/her predecessor was appointed. Any person appointed to fill a vacancy may, at the expiration of the unexpired term appointment, be reappointed for up to two (2) consecutive three-year terms, unless the expired term filled was for one-half (1/2) or more of a term, in which case the reappointment is limited to one (1) three-year term. After a person has served his/her maximum permitted consecutive terms, then the person may not be reappointed to the board until a full board term has expired.

The Park Board shall have power and it shall be its duty to take charge of and exercise the exclusive control, custody and supervision over all public parks owned or leased by the Town, or hereafter owned purchased or leased by the Town. It shall make all necessary rules and regulations for the operation and management of said parks and shall have such other powers as may be designated to it from time to time. Said Board shall comply with all of the provisions in the deeds conveying tracts of land for park purposes to the Town, and shall comply with all of the provisions contained in leases and agreements leasing tracts of land for park purposes. Where said Board may have athletic events, shows, and all other kinds of entertainment in the parks under its control and charge admission therefor, or said Board may permit or allow others to use parks and charge admissions for a rental to be charged and fixed by said Board, concession stands in said parks (except that no concession stand in any park under the control of said Board shall be permitted to sell intoxicating liquors of any kind or description), and all funds so derived by the Board shall be retained by said Board and used by said Board for the maintenance and development of the parks under its jurisdiction and control.

The Park Board shall have no authority to contract or incur any indebtedness for which the Town shall be liable without first securing the express consent of the Council.

The Board of Directors shall make, on or before the first Tuesday in January of each year, an annual report to the Council stating the condition of their trusts on the first day of January of the previous year, the various sums of money received by them and its source and how much monies have been expended and for what purposes, and the balance of money on hand as of that time; and the Board shall present to the Council, by the first meeting in October, their estimated budget setting out their estimate of the funds necessary to satisfactorily operate and maintain the park for the coming calendar year.

The Board shall hold regular meetings at least once a month at the time and place to be fixed by said Board and shall hold additional meetings upon the call of the President of the Board and shall do all things necessary to carry out the powers and duties of said Board.

At the October meeting each year, the Board shall elect from its members a president, vice president, secretary and treasurer, all of whom shall serve in their respective offices for a term of one (1) year and until their successors have been selected; no member of the Board shall hold more than one (1) of such offices at any one (1) time.
