As used in this Article, the following terms shall have the
meanings indicated:
Any designated enforcement officer possessing power to operate
within the City of Maysville.
Not under complete or immediate control of the owner or a
member of his immediate family or person responsible.
Any person, firm or corporation owning, harboring or keeping
a dog or other animal.
Owners are required to purchase a tag and license from the City
Clerk for each cat and dog they own. The fee for each license and
tag is five dollars ($5.00). This must be purchased each year for
each cat and dog on or by December 31. Every application for a license
shall be accompanied by a certificate from a qualified veterinarian
showing that the dog to be licensed has been given a vaccination against
rabies. After February 15th a ten dollar ($10.00) penalty will be
added to the cost of each tag. Tags must be attached to the collar
of said cat or dog and worn constantly.

It shall be unlawful for any person or persons owning, controlling, harboring, possessing, or having the management or care, in whole or in part, of any dog or cat to permit such animal or animals to run at large. For the purpose of this Article, every dog or cat when on any street, alley or any public place in the City of Maysville, which is not attached to a leash, the other end of which is securely held, or which is not confined as to prevent its straying from the premises, shall be deemed running at large; however, a dog or cat bearing an identification tag containing its name may remain on the property of its owner without a leash or other confinement. Upon conviction of Section 205.030 the penalty for conviction of the first offense shall be fifty dollars ($50.00); for conviction of the second offense shall be seventy-five dollars ($75.00); and for the third offense and each subsequent offense shall be one hundred dollars ($100.00).

The Animal Control Officer of the City shall impound any dogs
or cats found running at large within the City.

Any dog or cat may be redeemed from the pound by the owner's
making payment to the City Clerk for the cost of impoundment, licensing
of the animal if not already licensed and the cost of boarding which
is twenty-five dollars ($25.00) per day. Penalty for the first offense
is fifty dollars ($50.00). Penalty for the second offense is seventy-five
dollars ($75.00). Penalty for the third offense and each subsequent
is one hundred dollars ($100.00).

In case any dog or cat tag is lost, a duplicate tag may be issued
by the City Clerk upon presentation of a receipt showing the payment
of the license fee for the current year. The fee for a replacement
tag will be one dollar ($1.00).

It shall be unlawful to counterfeit tags or transfer tags to
another animal.

Any impounded dogs or cats not claimed within one (1) week shall
be disposed of in a humane manner.

It is unlawful for any unauthorized person to break open the
pound or to attempt to do so.

In addition to any other provisions herein contained, any person,
firm or corporation violating any of the provisions may be cited into
the Circuit Court of DeKalb County, Maysville Municipal Division.

A.
It shall be an ordinance violation for a real property owner of,
occupier of or any person with an actual or equitable interest in
real property to allow any animal to be housed, restrained or caged
in the front of a residential house or other building within the City
of Maysville for any length of time.
B.
A person who violates this Section shall be subject to a fine of
not more than five hundred dollars ($500.00) or imprisonment of not
more than ninety (90) days, or both such fine and imprisonment.

Any person, firm or corporation who shall violate any of the
provisions herein shall, upon conviction thereof, be deemed guilty
of an ordinance violation, and in addition to any other penalties
elsewhere provided in this Article, shall be punished by a fine of
not to exceed five hundred dollars ($500.00) or imprisonment in the
City or County Jail for a term not to exceed ninety (90) days, or
by both such fine and imprisonment. Each day this Article or any Section
of the same is violated shall constitute a separate offense and be
punishable under the provisions of this Section.
