As used in this chapter, the following terms shall have the meanings indicated:
SWIMMING POOL
Any structure, above or below ground, which is designed to contain water in excess of 12 inches and is primarily used for recreational activities of wading and/or swimming. This chapter shall apply to outdoor pools only.
No person shall construct or have constructed a swimming pool without first obtaining a permit therefor from the Building Inspector. Permits shall be obtained under the provisions of this chapter.
A. 
Every swimming pool constructed in the City shall be enclosed by a fence at least four feet in height and shall have no openings greater than four inches. Gates allowing access to the pool area shall be designed such that small children cannot open or close them. It shall be at the discretion of the Building Inspector as to whether or not a gate installed under this section meets this requirement.
B. 
Exceptions. Subsection A of this section shall not apply to the following:
(1) 
An aboveground type of pool with a deck extending perpendicular from the sides of the pool, if it has an affixed fence at least 30 inches in height above the deck level. Combined height of the pool plus the fence must be at least four feet in height; provided, however, that the minimum height of the pool plus the fence for any pool constructed between July 25, 1983, and the effective date of this chapter shall be at least 42 inches in height. Access to such deck or pool shall have removable steps or ladder, or a ladder that can be flipped up and locked to prevent uncontrolled access, or a fence, minimum of four feet, enclosing the access area.
(2) 
The entire swimming area is covered or enclosed by a plastic or fiberglass dome or bubble capable of supporting a one-hundred-fifty-pound load. The gate or door which allows access into the swimming area must be self-closing and self-latching which will prevent uncontrolled access.
(3) 
An above-the-ground type of swimming pool whose accumulative height, with or without affixed fence, is at least four feet above ground at all points. Access to such pool shall have removable steps or ladder, or a ladder that flips up and can be locked so as to prevent uncontrolled access.
(4) 
Small portable plastic wading or kiddie pools are not required to have a fence surrounding them, provided the pool is emptied of all water whenever it is unattended.

All swimming pools maintained in the City shall meet with any state, county, or local requirements involving health regulations or other rules applicable to swimming pools.
