Except as provided below, the consumption of alcohol is prohibited
on all property over which the Town has supervision and control. The
maximum penalty for first offense shall be a fine of up to $100, any
portion of which may be suspended. Conviction of a second or subsequent
offense shall be a fine of $150, and no portion of the fine may be
suspended.

A. In accordance with the provisions of Subsections
B through
K below, and RSA 178:22-V(1), licensing shall be limited to events sponsored or organized by a nonprofit organization seeking to serve and offer for sale beer and wine for consumption in Town buildings and on Town premises, as permitted in Subsection
E below. The nonprofit organization shall first apply for the applicable permit with the Town Manager's office.
B. To
qualify for a permit under this chapter, events sponsored or organized
by a non-profit group shall obtain a license from the New Hampshire
Liquor Commission under RSA 178:22-V(1).
C. The
Town shall require a permit application, which shall include standards
for issuance of the permit to serve and offer for sale beer and wines
for consumption on Town property.
D. No
permit to serve and offer for sale beer and wine for consumption on
Town property shall be granted for the hours between 10:00 p.m. and
10:00 a.m. However, in no case shall alcoholic beverages be provided
or consumed in the Great Hall during the hours that the town offices
are open to the public.
E. Permitted
locations to serve and offer for sale beer and wines for consumption,
subject to the applicable license:
(1) Town Hall - Great Room, in accordance with the Town's Great
Hall use policy.
(2) Abenaki Lodge, and during the months of June through August only,
its outside patio and adjoining area, in accordance with the Town's
Abenaki use policy.
(3) Libby Museum, in accordance with the museum's use policy.
(4) Cate Park, town park and dockside, permitted between January 1 through
April 1 and subject to a temporary event permit.
(5) Clark House Museum Complex.
F. Application
for a permit under this section may be made at the office of the Town
Manager.
G. The
Police Chief, Director of Public Works, Fire Chief and Parks/Recreation
Director (where applicable for Town Parks) shall review the application
for completion and transfer it to the appropriate authority with any
comments, or concerns, or conditions for review to the Town Manager
for review.
H. The
issuance of a permit shall also require a public hearing and approval
by the Board of Selectmen. Notice of a public hearing shall consist
of certified mail notice to the applicant and the posting of notice
in at least two prominent locations in Town at least seven days prior
to the hearing.
I. To
the extent the applicant meets all of the standards for issuance of
a permit, the Board of Selectmen may conditionally issue the permit,
which shall not become valid until the applicant provides the Town
Manager with an RSA 178:22-V(1) license from the New Hampshire Liquor
Commission for the applicable license issuance time period, if such
a license is required for the event.
J. The
fee for said permit shall be $50.
K. Notwithstanding
any provision contained in this chapter, the Town shall not be prohibited
from allowing the lessee of the dockside restaurant building to obtain
a liquor license pursuant to RSA Chapter 178 and to offer for sale
and consumption beer and wine to customers who purchase food for consumption
on the premises.
L. A
nonprofit or governmental organization may also apply for a permit
to allow persons attending an event sponsored by them to bring their
own beer or wine to the event. Such permits may be issued for use
in the Town Hall Great Room, Abenaki Lodge, the Libby Museum and the
Clark House Museum Complex. In order to obtain a permit for such events,
the applicant must also provide proof of liability insurance that
included alcoholic beverages coverage and which names the Town as
an additional insured. As with a permit to offer beer and wine for
sale at such events, the Board of Selectmen may impose reasonable
conditions upon the event.
