The Borough does hereby approve a schedule of attorneys'
fees pursuant to 53 P.S. § 7106 as set forth on Exhibit
"A" attached hereto, which fee structure can be updated from time
to time and approved by Borough Council by resolution.
At least 30 days prior to assessing or imposing attorneys'
fees in connection with the collection of a delinquent account, the
Borough will mail to the owner, by certified mail, return receipt
requested, notice that the Borough intends to impose or assess attorneys'
fees. Said notice shall include instructions on how the recipient
of the letter may avoid the payment of attorneys' fees.
If, within 30 days of mailing the notice, the certified mail
is refused or unclaimed or the return receipt is not received, then
at least 10 days prior to assessing or imposing attorneys' fees
in connection with the account, the Borough shall mail to the owner
notice as required by § 7106(a).
This article is ordained and enacted pursuant to Act 1 which
amends 53 P.S. § 7106(a).

In such cases where the Borough of East Petersburg, Lancaster
County, Pennsylvania, enforces its ordinances by civil proceedings
or as a summary offense and in such cases where the person against
whom the action is filed is found guilty of the offense or offenses
under the ordinance, such person shall also be assessed the court
costs and attorneys' fees incurred by the Borough in such enforcement
proceedings.
The Borough Council of East Petersburg shall set the amount
of attorneys' fees by resolution.
All ordinances inconsistent herewith are hereby repealed.
If any portion of this article is found by a court of competent
jurisdiction to be unconstitutional, illegal or invalid, such decision
shall not affect or impair the validity of the remaining portions
of this article.
