This article shall govern the operation of all valet parking services provided by businesses located within the Town Center Zoning District of the Borough.
As used in this article, the following terms shall have the meanings indicated:
VALET PARKING
A parking service offered and/or provided by a business, whereby an attendant parks and retrieves patrons' vehicles.
No business located in the Town Center Zoning District may offer and/or provide valet parking services without adhering to requirements set forth in this article.
A. 
All new applicants who intend to offer and/or provide valet parking service should consult with the Parking Services Department of the Borough prior to the submission of an application for a valet parking service operation.
B. 
All applications for valet parking service shall consist of the following materials, copies of which are available at the Borough of West Chester and its website (www.west-chester.com):
(1) 
Application form;
(2) 
A license agreement entered into between the business offering and/or performing a valet parking service and the Borough;
(3) 
A one-page diagram or site plan depicting the street and/or garage location(s) where vehicles will be picked up and dropped off as part of the valet parking service. This diagram or site plan must clearly indicate the number and location of parking meters that may be involved in the valet parking service (i.e., the reserved area);
(4) 
Required insurance information; and
(5) 
Application fee.
C. 
All businesses offering and/or providing valet parking service in the Town Center Zoning District must complete the requisite application form and enter into a license agreement with the Borough prior to offering and/or providing any valet parking service.
D. 
A valet parking service approved by the Borough shall be valid from the date of issuance until the end of the calendar year in which the approval was issued. There shall be no proration of fees.
E. 
The Parking Services Department of the Borough shall send valet parking service renewal notices and application packets to businesses offering and/or performing a valet parking service on or before October 15 of each year. Completed valet parking service application packets must be submitted to the Borough no later than December 1 of that same year. Completed valet parking service packets for renewal will be accessed a late fee as determined by Resolution of Borough Council, if received by the Borough between December 2 and December 31. Renewal packets submitted to the Borough after December 31 will not be accepted and a valet parking service approval will not be extended by the Borough to the renewal business applicant for the subsequent year.
F. 
All valet parking service license agreements and related materials will be kept on file in the Parking Services Department of the Borough. Copies of the license agreements, diagrams/site plans, as well as any supplementary materials, will be forwarded to the Borough Police Department.
The Borough shall collect a fee in an amount established by Borough Council by resolution for processing the initial application fees, renewal application fees, one-day and special event fees and late application fees.
Use of a public parking garage or surface lot owned by the Borough for a valet parking service requires an additional daily fee, as determined by resolution of the Borough Council, for each space that is to be utilized. Accommodations must be made with the Borough at least one week in advance of the planned usage to arrange for the use of a public parking facility.
The following spaces shall not be used for valet parking services offered and/or performed in the Town Center Zoning District:
A. 
Use of street metered parking;
B. 
Double parking on public streets;
C. 
Blocking of public and private points of ingress and egress onto public streets;
D. 
Unauthorized use of private, non-Borough public parking areas; and
E. 
The use of more than four metered parking spaces in parking lots and parking garages.
A. 
A certificate of insurance and endorsement naming the Borough of West Chester as an additional insured must accompany all applications, including annual renewals. The certificate shall also include the name of the business applying for valet parking service approval, as well as the business' location. The certificate must also be part of the valet parking application packet submitted to the Borough. Without such certificate containing the required endorsement, the submission will be deemed incomplete and valet parking service will not be permitted.
B. 
The certificate of insurance must include as an additional insured, "The Borough of West Chester, including any and all elected and appointed officials, employees, agents and representatives."
C. 
The Borough reserves the right to require a certified copy of any business's insurance policy.
D. 
The certificate of insurance must include a cancellation notice that provides the following: "Should any of the above-described policies be cancelled before the expiration date thereof, notice will be delivered in accordance with the policy provisions."
E. 
All insurance policies required hereunder shall be endorsed to provide that the policy is not subject to cancellation or nonrenewal until 30 days prior written notice has been provided to the business and the Borough.
F. 
Insurance shall be maintained by the business in the following minimum amounts of coverage, which shall cover the valet parking service:
(1) 
Comprehensive general liability: not less than $1,000,000 per occurrence and/or aggregate, combined single limit for personal injury, bodily injury and property damage.
(2) 
Comprehensive auto liability: not less than $1,000,000 per occurrence and/or aggregate, combined single limit for personal injury, bodily injury and property damage.
(3) 
Worker's compensation and employers' liability insurance: Statutory minimum.
A. 
Suspension of valet parking approval. The Borough Manager may suspend a business's ability to offer and/or provide valet parking service for no more than 30 days if:
(1) 
A business is found to have knowingly provided false information in the application process (as set forth in § 104-110 above); or
(2) 
A business has received two notices of violation, verbal or written, of any provision of this article within the same calendar year.
B. 
Revocation of valet parking approval. The Borough Manager may revoke a business's ability to offer and/or provide valet parking service for the remainder of the calendar year if a business has received three notices of violation, verbal or written, of any provision of this article within the same calendar year.
C. 
A business may not receive a valet parking service approval unless all fines accrued for any violation of this article from previous year(s) have been paid.
D. 
Any business violating any of the provisions of this article shall be sentenced to pay a fine of no less than $50 and no greater than $600, together with costs of prosecution. The imposition of a penalty as provided herein shall not serve to prevent the abatement of any nuisance or to prevent the suspension or revocation of the approval held by any business who shall violate the provisions of this article, or any other law or ordinance while engaged in activities permitted under the provision of this article. Each day of a violation shall constitute a separate offense which shall be punishable by a separate fine.
