This chapter shall be known as the "Codification of Fees and Costs of the Township of Monroe."
This chapter is adopted in order to advise the citizens of the Township and any and all persons doing business with the Township of the various fees charged for services rendered by the departments of Township government and to provide ready access to any and all such information.
A. 
The fees which follow shall be charged by the Township for services rendered or licenses or permits issued.
B. 
All license and permit fees shall be annual, unless otherwise noted.
C. 
Miscellaneous fees shall be $5.

(a) 
The actual cost (materials and supplies, but no staff labor) of duplication or reproduction; plus
(b) 
A special service charge of the actual direct cost of labor shall be imposed for each hour of extraordinary time predicted to be utilized to respond to the request. Actual direct cost shall mean the hourly rate of the lowest level employee capable of fulfilling the request. An estimate of same shall be provided first to the requestor before the request is processed and the charges are imposed.
(7) 
Victims of crimes or offenses are exempt from fees.

Said fee will be utilized by the Township to pay the costs of any Township professionals who may be required to attend said meeting or who are consulted upon for their services. The purpose of said fee is to offset any costs to the residents of the Township and shall be solely borne by the interested party. This fee does not constitute the payment of professional fees as defined pursuant to N.J.S.A. 40:55-53.1. If in the event there is to be a reimbursement of any unused portion of the fee, the Chief Financial Officer shall provide for said reimbursement in a timely fashion under such guidelines as established within the Department of Finance.

A. 
The Township of Monroe hereby declares its acceptance of N.J.S.A. 24:6I-1, et seq. entitled "Jake Honig Compassionate Use Medical Cannabis Act" (hereinafter referred to as the "Act").
B. 
Pursuant to N.J.S.A. 24:6I-10, the Township of Monroe hereby adopts an ordinance imposing a transfer tax on any medical cannabis dispensed by any dispensary located within the Township, including medical cannabis that is furnished by the dispensary to a medical cannabis handler for delivery to a registered qualifying patient or the patient's caregiver.
C. 
The Township of Monroe hereby establishes a 2% gross rate of a transfer tax of the purchase price of the medical cannabis sold at a licensed medical cannabis alternative treatment centers as defined by the Act located in the Township and also require medical alternative treatment centers to make an annual prepayment of such 2% sales tax equal to an alternative treatment center's annual (twelve-month period) projected gross revenue (as defined by N.J.S.A. 40A:20-3) of cannabis to be sold at such alternative treatment center.
D. 
The Township and the alternative treatment center will complete a reconciliation of projected annual gross revenue against actual annual gross revenue (as defined by N.J.S.A. 40A:20-3), at which time the actual amount due pursuant to the above will be deducted from initial prepayment made by an alternative treatment center. The remainder of prepayment (to the extent such remainder exists) will be used to cover future taxes owed by an alternative treatment center pursuant to this section.
E. 
The Township and the alternative treatment center shall enter into any sales and use tax agreements as may be required by New Jersey law.

The Township of Monroe hereby establishes a tax or fee to be imposed on the sale or transfer of cannabis. Every cannabis establishment shall pay an excise tax on the sale or transfer of cannabis to the Township of Monroe at the highest rate established by State Statute, N.J.S.A. § 40:48I-1 currently permits: 2% of the gross receipts from each sale by a cannabis cultivator; 2% of the gross receipts from each sale by a cannabis manufacturer; 1% of the gross receipts from each sale by a cannabis wholesaler; and 2% of the gross receipts from each sale by a cannabis retailer.

The nonrefundable application fee for the initial license and license renewal for Classes 1 through 6 licenses shall be as follows:
