The Borough of Mount Ephraim hereby adopts the current Manual on Uniform Traffic Control Devices ("M.U.T.C.D."), except as supplemented and amended, as it controls and regulates the construction or maintenance operations of utility work that obstructs the normal flow of traffic. Any person, contractor, or utility who fails to comply with the provisions of M.U.T.C.D. while performing such work shall be in violation of this section.
A. 
In the event of an emergency, unplanned or unanticipated underground, aboveground or other repair to public utilities, including roadway failures, the private entity or public utility responsible for the repair, installation or replacement, as the case may be, shall be required to obtain prior written permission from the Mount Ephraim Police Department and contract with the Mount Ephraim Police Department or other bona fide New Jersey law enforcement agency having jurisdiction for any necessary traffic control associated therewith. In the event any other bona fide New Jersey law enforcement agency is used for traffic control, such agency must notify the Chief, or his designee, and obtain written permission prior to the commencement of any such work. For purposes of this section, emergency or unplanned work shall include that which results from any crash, accident, failure, disaster, storm, weather or any other cause which affects a portion of any Mount Ephraim roadway or other right away that is impacted by such work.

B. 
The number of law enforcement officers and equipment to be used in conjunction with any such emergency, unplanned or unanticipated work shall be determined by the Chief of Police or his designee. Any and all law enforcement services rendered in accordance with this section shall be reimbursed within seven business days thereof.
A. 
Any person, contractor, or utility performing any highway maintenance or construction as provided for under this Article XIII shall provide the Mount Ephraim Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work.
B. 
If, for any reason, the emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Borough may respond and correct such hazardous condition. In that event, the reasonable fees for such emergency service provided by the Borough shall be charged to the person, firm, contractor, or utility responsible for such condition, which shall be due and payable to the Borough of Mount Ephraim in full within 10 business days.
Road closing and/or traffic detours shall not be permitted unless approved in advance by the Mount Ephraim Police Department. Any redirection, movement, shifting and/or detouring of traffic, whether pedestrian or vehicle, must be approved by the Mount Ephraim Police Department prior thereto.
Traffic directors shall be posted at all construction or maintenance sites when determined by the Mount Ephraim Police Department that same is necessary to provide for the safe and expeditious movement of traffic. The officer in charge of the Mount Ephraim Police Department shall be vested with the authority to determine whether police traffic control is required or whether civilian flaggers are adequate.
The Mount Ephraim Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of any section of this Article XIII or any other applicable provision of the Code of the Borough of Mt. Ephraim.

Any person, firm, contractor or public or private utility who violates any provision of this Article XIII shall, upon conviction thereof, be subject to the penalty provisions contained in Chapter 305, Penalties.
