As used in this chapter, the following terms shall have the meanings
indicated:
ACT or THE ACT
The Federal Water Pollution Control Act, also known as the
"Clean Water Act," as amended by the Federal Water Pollution Control
Act Amendments of 1972, the Clean Water Act of 1977 and the Water
Quality Act of 1987, 33 U.S.C. § 1251 et seq., and any subsequent
amendments thereto.
APPROVAL AUTHORITY
The Director in an NPDES state with an approved state pretreatment
program and the Administrator of the EPA in a non-NPDES state or NPDES
state without an approved state pretreatment program.
AUTHORIZED AGENT
An employee of the operator, professional engineer, industrial
pretreatment program coordinator, plumbing inspector, or other qualified
person authorized by the operator to administer and enforce this chapter.
AUTHORIZED REPRESENTATIVE OF INDUSTRIAL, COMMERCIAL, INSTITUTIONAL
OR SIGNIFICANT USER
(1)
In the case of a corporation:
(a)
A president, secretary, treasurer or vice president of the corporation
in charge of a principal business function, or any other person who
performs similar policy or decisionmaking functions for the corporation.
(b)
The manager of one or more manufacturing, production or operation
facilities, provided the manager is authorized to make management
decisions that govern the operation of the regulated facility, including
having the explicit or implicit duty of making major capital investment
recommendations, and initiate and direct other comprehensive measures
to assure long-term environmental compliance with environmental laws
and regulations; can ensure that the necessary systems are established
or actions taken to gather complete and accurate information for wastewater
discharge permit requirements; and where authority to sign documents
has been assigned or delegated to the manager in accordance with corporate
procedures.
(2)
In the case of a partnership or sole proprietorship, a general
partner or proprietor, respectively.
(3)
If the user is a federal, state or local facility, a director
or highest official appointed or designated to oversee the operation
and performance of the activities of the government facility or his
or her designee.
(4)
A duly authorized representative of the individual designated
above if such representative is responsible for the overall operation
of the facilities from which the indirect discharge into the publicly
owned treatment works (POTW) originates; the authorization is in writing;
and the written authorization is submitted to the POTW.
BEST MANAGEMENT PRACTICES (BMPS)
Schedules of activities, prohibitions or practices, maintenance
procedures, and other management practices to implement the prohibitions
listed in 40 CFR 403.5(a)(1) and (b). BMPs include treatment requirements,
operating procedures, and practices to control plant site runoff,
spillage or leaks, sludge or waste disposal, or drainage from raw
materials storage.
BIOCHEMICAL OXYGEN DEMAND (BOD)
The quantity of oxygen utilized in the biochemical oxidation
of organic matter under standard laboratory procedure for five days
at 20° C., expressed in terms of weight and concentration [milligrams
per liter (mg/l)].
BUILDING SEWER
A private sewer conveying wastewater from the premises of
a user to the Springfield System or City wastewater system.
BYPASS
The intentional diversion of waste streams from any portion
of an industrial user's pretreatment facility.
CARBONACEOUS BIOCHEMICAL OXYGEN DEMAND (CBOD)
The quantity of oxygen utilized in the biochemical oxidation
of carbonaceous organic matter under standard laboratory procedures,
five days at 20° C., expressed in terms of concentration [milligrams
per liter (mg/l)].
CITY
The City of Philadelphia.
COLLECTOR SYSTEM
All piping leading to a treatment plant, including those
pipes connected to a combined sewer overflow which lead directly to
a receiving stream.
COMMISSIONER
The Water Commissioner of the City of Philadelphia or his
designee.
COMPATIBLE POLLUTANTS
Those pollutants, as defined by the United States Environmental
Protection Agency pursuant to P.L. 92-500 (Federal Water Pollution
Control Act Amendments of 1972), amenable to treatment in a publicly
owned treatment works (POTW). Compatible pollutants include but are
not necessarily limited to biochemical oxygen demand, suspended solids
and fecal coliform bacteria.
COMPOSITE SAMPLE
A timed sequential collection of samples of equal volume
or a collection of grab samples combined in a single reservoir to
determine concentration(s) of pollutant(s).
CONTROL AUTHORITY
Refers to the respective operator of a sanitary sewer system
or treatment plant.
COOLING WATER
The water discharged from any use such as air conditioning,
cooling or refrigeration or to which the only pollutant added is heat
and which does not contain a level of contaminants detectably higher
than that of the source of the water.
DAILY MAXIMUM
The maximum allowable discharge of a pollutant during a calendar
day or other twenty-four-hour period as allowed by the POTW. Where
maximum limitations are expressed in units of mass, the daily discharge
is the total mass discharged over the course of a day. Where daily
maximum limitations are expressed in terms of concentration, the daily
discharge is the arithmetic average measurement taken that day.
DEPARTMENT
The Sewer Department of the Bucks County Water and Sewer
Authority or the City of Philadelphia Water Department, as applicable.
DIRECT DISCHARGE
The discharge of treated or untreated wastewater directly
to the waters of the Commonwealth of Pennsylvania which may occur
through the City's stormwater conduits or combined sewer outfall
structures.
DISCHARGE
The placing of surface or underground water or of any wastes
such as but not limited to stormwater, leachate, underground leaks
or wastewater into a POTW.
DOMESTIC CONSUMER UNIT
A dwelling or structure normally occupied by a single family.
The daily flow is based on 3.33 persons per dwelling by 75 gallons
per person per day or 250 gallons per day per single-family dwelling.
DOMESTIC SEWAGE/WASTEWATER
Normal water-borne fluid wastes from residences, commercial
establishments, institutions and industrial facilities, limited to
the wastes associated with laundries or resulting from natural human
waste elimination associated with bodily function and/or food preparation
originating in bathrooms, lavatories and kitchens.
ENVIRONMENTAL PROTECTION AGENCY or EPA
The United States Environmental Protection Agency, or, where
appropriate, the term may also be used as a designation for the Administrator
or other duly authorized official of said agency.
EQUIVALENT DWELLING UNIT (EDU)
Any source of wastewater into the Springfield System which
has the following typical wastewater characteristics: flow, 250 gallons
per day (gpd), which shall be utilized to determine the ratio for
nonresidential wastewater flow in proportion to a domestic consumer
unit.
(1)
For nonresidential establishments, the number of EDUs shall
be based on the following categories:
(a)
Offices, retail, industrial and commercial connections: PA DEP
usage standards or comparable use data provided to BCWSA.
(b)
Warehouse connections: one EDU per each 4,375 square feet.
(2)
The number of EDUs for all other categories shall be as determined
by the BCWSA based on PA DEP usage standards or comparable use data
provided to BCWSA.
FATS, OILS AND GREASE
Any material which is extractable from an acidified sample
of a waste by using 1, 1, 2-thrichloro 1, 2, 2 trifluoroethane (Freon
TF or Genesolv D, registered trademarks).
FLASH POINT
The temperature at which a liquid or volatile solid gives
off vapor sufficient to form an ignitable mixture with the air near
the surface of the liquid or within the text vessel. "Flash point"
is determined by the Tagliabue open cup method (American Society for
Testing and Materials D1310-63), usually abbreviated "TOC."
GRAB SAMPLE
A sample which is taken from a waste stream on a one-time
basis in 15 minutes or less and with no regard to the flow in the
waste stream.
GRINDER PUMP
Any electric-motor-driven, submersible pump capable of macerating
all material found in normal domestic sanitary sewage, including,
but not limited to, reasonable amounts of objects, such as plastics,
sanitary napkins, disposable diapers, rubber and the like, to fine
slurry, and pumping this material through a small-diameter discharge.
HOLDING TANK WASTE
Any waste from holding tanks such as vessels, chemical toilets,
campers, trailers, septic tanks and vacuum-pump tank trucks.
INCOMPATIBLE POLLUTANTS
Any pollutant which is not a compatible pollutant as defined
by the regulations of the Environmental Protection Agency pursuant
to P.L. 92-500 [1972 Federal Water Pollution Control Act Amendments(s)
or its amendments].
INDIRECT DISCHARGE
The discharge or the introduction of pollutants, including
holding tank waste, into the POTW.
INDUSTRIAL WASTE
Any liquid, gaseous or solid substances, or combinations
thereof, resulting from industrial manufacturing processes, trade
or business, as distinct from domestic sewage.
INSTANTANEOUS MAXIMUM ALLOWABLE DISCHARGE LIMIT
The maximum concentration of a pollutant allowed to be discharged
at any time, determined from the analysis of any discrete or composited
sample collected; independent of the industrial flow rate and the
duration of the sampling event.
INTERFERENCE
(1)
A discharge which, alone or in conjunction with a discharge
or discharges from other sources, inhibits or disrupts the POTW, its
treatment processes, operations, maintenance or its sludge processes,
use or disposal and, therefore, is a cause of a violation of any requirement
of the POTW's NPDES permit (including an increase in the magnitude
or duration of a violation) or of the prevention of sewage sludge
use or disposal in compliance with the following statutory provisions
and regulations or permits issued thereunder (or more-stringent state
or local regulations): Section 405 of the Clean Water Act, the Solid
Waste Disposal Act (SWDA) [including Title II, more commonly referred
to as the "Resource Conservation and Recovery Act" (RCRA)], and including
state regulations contained in any state sludge management plan prepared
pursuant to Subtitle d of the SWDA, the Clean Air Act, the Toxic Substances
Control Act and the Marine Protection, Research and Sanctuaries Act.
(2)
In addition, "interference" shall mean the following:
(a)
The introduction of pollutants into the POTW which, alone or
in conjunction with other discharges, inhibits or disrupts the process,
operations or maintenance of the POTW or causes an evacuation of any
POTW personnel, whether or not it causes or contributes to a violation
of the POTW's NPDES permit.
(b)
The introduction of pollutants, either alone or in conjunction
with other discharges, which, when reaching the treatment plant, inhibits,
disrupts or limits the solid waste by-products disposal options available
to the POTW, whether or not it causes or contributes to a violation
of Section 405 of the Act, the Solid Waste Disposal Act or any other
law or regulation regulating solid waste by-products.
(c)
The introduction of pollutants into the City's collector
system which, alone or in conjunction with other discharges, inhibits,
disrupts or adversely affects the operations or maintenance of the
collector system.
INTERMUNICIPAL AGREEMENT(S)
The latest editions of the agreements and amendments thereto
for Cheltenham Township, Abington Township, Whitemarsh Township, Upper
Dublin Township and the City of Philadelphia to provide for the discharge
of certain sewage from and to the municipalities.
MEDICAL WASTE
Isolation wastes, infectious agents, human blood and blood
products, pathological wastes, sharps, body parts, contaminated bedding,
surgical wastes, potentially contaminated laboratory wastes and dialysis
wastes.
MONTHLY AVERAGE
The arithmetic mean of the values for effluent samples collected
over a calendar month.
NATIONAL CATEGORICAL PRETREATMENT STANDARD or PRETREAMENT STANDARD
Any regulation containing pollutant discharge limits promulgated by the EPA in accordance with Section 307(b) and (c) of the Act (33 U.S.C. § 1317), which applies to a specific category of industrial users, and pretreatment standards as published in 40 CFR Chapter
1, Subchapter N, Parts 401-471.
NEW SOURCE
(1)
Any building, structure, facility or installation from which
there is or may be a discharge of pollutants, the construction of
which commenced after the publication of proposed pretreatment standards
under Section 307(c) of the Act which will be applicable to such source
if such standards are thereafter promulgated in accordance with that
section, provided that:
(a)
The building, structure, facility or installation totally replaces
the process or production equipment that causes the discharge of pollutants
at an existing source.
(b)
The production or wastewater-generating processes of the building,
structure, facility or installation are substantially independent
of an existing source at the same site. In determining whether these
are substantially independent, factors such as the extent to which
the new facility is integrated with the existing plant and the extent
to which the new facility is engaged in the same general type of activity
as the existing source should be considered.
(2)
Construction on a site at which an existing source is located
results in a modification rather than a new source if the construction
does not create a new building, structure, facility or installation
meeting the criteria of Subsection A(1)(a) or (b) above but otherwise
alters, replaces or adds to existing process or production equipment.
(3)
Construction of new source as defined under this subsection
has commenced if the owner or operator:
(a)
Has begun, or caused to begin, as part of a continuous on-site
construction program:
[1]
Any placement, assembly, or installation of facilities or equipment.
[2]
Significant site preparation work, including clearing, excavation
or removal of existing buildings, structures or facilities which is
necessary for the placement, assembly or installation of new source
facilities or equipment.
(b)
Entered into a binding contractual obligation for the purpose
of facilities or equipment which are intended to be used in its'
operation within a reasonable time. Options to purchase or contracts
which can be terminated or modified without substantial loss and contracts
for feasibility, engineering and design studies do not constitute
a contractual obligation under this subsection.
NONCONTACT COOLING WATER
Water used for cooling which does not come into direct contact
with any raw material, intermediate product, waste product or finished
product.
NONDOMESTIC USERS
Commercial, industrial, municipal or other users whose discharge
may have an effect on the sanitary sewer system.
OCCUPIED BUILDING
Any structure erected and intended for continuous or periodic
habitation, occupancy or use by human beings or animals and from which
structure domestic sewage and industrial wastes, or either thereof,
is or may be discharged, and a portion of all of which structure is
situate 300 feet or less from the nearest edge of the right-of-way
or a sanitary sewer easement, provided that such property abuts or
has direct access to the right-of way or easement.
OPERATOR
An entity lawfully operating a public sanitary sewer system
in the Township or receiving sewage from within the Township for further
conveyance and/or treatment. Operators serving the Township include,
but may not be limited to, Bucks County Water and Sewer Authority
(BCWSA), Abington Township, and Cheltenham Township.
PASS-THROUGH
A discharge which exits the POTW to the receiving stream
or its atmosphere in quantities or concentrations which, alone or
in conjunction with other discharges, is a cause of a violation of
any requirement of the POTW's NPDES permit or a violation of
any air emission standard set by the Clean Air Act or state or local
rules and regulations governing emissions to the air (including an
increase in the magnitude or duration of a violation).
PERSON
Any individual, partnership, copartnership, firm, company,
corporation, association, joint-stock company, trust, estate, governmental
entity or any other legal entity or their legal representatives, agents
or assigns. The masculine gender shall include the feminine, and the
singular shall include the plural where indicated by the context.
pH
A measure of the acidity or alkalinity of a solution, expressed
in standard units.
POLLUTANT
Any dredged spoil, solid waste, incinerator residue, filter
backwash, sewage, garbage, sewage sludge, munitions, medical wastes,
chemical wastes, biological materials, radioactive materials, heat,
wrecked or discharged equipment, rock, sand, cellar dirt, industrial,
municipal and agricultural waste or any other contaminant discharged
into water. The term includes certain characteristics of wastewater
(e.g., pH, temperature, TSS turbidity, color, BOD, CBOD, COD toxicity
or odor).
POLLUTION
The man-made or man-induced alteration of the chemical, physical,
biological and radiological integrity of water.
PRETREATMENT or TREATMENT
The reduction of the amount of pollutants, the elimination
of pollutants or the alteration of the nature of pollutant properties
in wastewater to a less-harmful state prior to, or in lieu of, discharging
or otherwise introducing such pollutants into a POTW. The reduction,
elimination or alteration can be obtained by physical, chemical or
biological processes, process changes or other means, except as prohibited
by 40 CFR 403.6(d).
PRETREATMENT STANDARDS OR REQUIREMENTS
Any substantive or procedural requirement related to pretreatment,
including, but not limited to, those requirements found in the Clean
Water Act, the General Pretreatment Regulations (40 CFR 403), the
National Categorical Pretreatment Standards, the Resource Conservation
and Recovery Act (42 U.S.C. § 6901 et seq.) and the Solid
Waste Management Act (35 P.S. § 6018.101 et seq.), as they
relate to the proper disposal of pretreatment sludges, the City of
Philadelphia wastewater control regulations and any order issued under
those regulations, the industrial user's wastewater discharge
permit and any other federal, state or local law or regulation which
regulates discharges to the POTW.
PRIVATE LATERAL
A sanitary sewer lateral ("lateral") is the pipe which conveys
sanitary sewage from a building unit to the sanitary sewer main. The
ownership and, therefore, maintenance and/or repair of the lateral
is the responsibility of the property owner. This includes the entire
run of lateral piping, including the cleanout(s), up to, and including,
the wye connection to the main, as well as any trench, pavement, curbing
and/or sidewalk restoration required. The type and installation of
the lateral must conform to the specifications under Section 3.14
of the BCWSA Sanitary Sewer Specifications (latest revision).
PROCESS WASTEWATER
Any water which, during manufacturing or processing, comes
into direct contact with or results from the production or use of
any raw material, intermediate product, finished product, by-product
or waste product.
PUBLICLY OWNED TREATMENT WORKS (POTW)
A treatment works, as defined by Section 212 of the Act (33
U.S.C. § 1292), which is owned by the City of Philadelphia,
including any devices and systems used in the storage, treatment,
recycling or reclamation of municipal sewage and industrial waste.
This definition includes any sewers that convey wastewater to the
POTW treatment plant but does not include pipes, sewers or other conveyances
not connected to a facility providing treatment. For the purposes
of this regulation, "POTW" shall also include any sewers that convey
wastewaters to the POTW from persons outside the City who are, by
contract or agreement with the City, users of the City's POTW.
REGULATORY AGENCY
Agencies such as, but not limited to, the Pennsylvania Department
of Environmental Protection, the United States Environmental Protection
Agency, the Delaware River Basin Commission (DRBC) and the United
States Coast Guard, which have authority over the operations of and/or
discharges into and/or from wastewater treatment facilities.
RIGHT-OF-WAY
Includes the cartway and the shoulder of the street or road
in which a sewer main is located.
SANITARY SEWER SYSTEM
Refers to a sanitary sewage collection, pumping, transport,
and/or treatment system acquired or constructed by and operated by
an operator serving the Authority and all additions, extensions and
improvements thereto, but excluding stormwater management facilities
and storm sewers.
SEWAGE
A combination of the water-carried wastes from residences,
business buildings, institutions and industrial establishments, together
with such groundwater, surface water and stormwater as may be inadvertently
present in sanitary sewers. The mixture of sewage, as above defined,
with industrial wastes or other wastes also should be considered wastewater
within the meaning of the definition.
SIGNIFICANT INDUSTRIAL USER (SIU)
(1)
Any industrial user subject to any National Categorical Pretreatment
Standard; or
(2)
Any industrial user that discharges an average of 25,000 gallons
per day or more of process wastewater to the POTW (excluding domestic,
noncontact cooling and boiler blowdown wastewater) or contributes
a process waste stream which makes up 5% or more of the average dry-weather
hydraulic or organic capacity of the POTW treatment plant; or
(3)
Any industrial user that is found by the City, DEP or EPA to
have a reasonable potential, either alone or in conjunction with other
discharges, to adversely affect the POTW, the collector system, the
solid waste by-products of the POTW or air emissions from the POTW.
SIGNIFICANT NONCOMPLIANCE (SNC)
An industrial user or user is in significant noncompliance
if its violation meets one or more of the specific criteria set forth
in 40 CFR 403.8(f)(2)(vii).
SOURCE
Any person discharging industrial wastes and other polluted
discharges.
SPILL or SLUG DISCHARGE
Any discharge of a nonroutine, episodic nature, including, but not limited to, an accidental spill or noncustomary batch discharge, or any discharge at a flow rate or concentration which could cause a violation of the prohibited discharge standards found in §
81-25 of these regulations.
STANDARD INDUSTRIAL CLASSIFICATION (SIC)
A classification pursuant to the Standard Industrial Classification
Manual issued by the Executive Office of the President, Office of
Management and Budget, 1972, as amended.
STATE
The Commonwealth of Pennsylvania.
STORM SEWER
A public or private conveyance or system of conveyances (including
roads, streets, catch basins, curbs, gutters, ditches, man-made channels,
swales, pipes, culverts or storm drains and other stormwater management
facilities) primarily used for collecting and conveying stormwater
runoff.
STORMWATER
Any flow occurring during or following any form of natural
precipitation and resulting therefrom.
SUSPENDED SOLIDS
The total suspended matter that floats on the surface of
or is suspended in water, wastewater or other liquids, and which is
removable by laboratory filtering, expressed in terms of concentration
[milligrams per liter (mg/l)].
TOWNSHIP
Springfield Township, Montgomery County, Pennsylvania.
TOXIC POLLUTANT
Any pollutant or combination of pollutants listed as toxic
pursuant to Pennsylvania Statutes and Rules, Section 307(a) of the
Act or other federal statutes.
USER
Any person who contributes, causes or permits the contribution
of wastewater into the POTW facilities.
WASTES
Any liquid, gaseous or solid substances or combinations thereof
which are discarded, leached or spilled substances or combinations
thereof, including domestic sewage and industrial wastes, but excluding
stormwater.
WASTEWATER
The liquid and water-carried industrial or domestic wastes
from dwellings, commercial buildings, industrial facilities and institutions,
together with any groundwater, surface water and stormwater that may
be present, whether treated or untreated.
WATERS OF THE COMMONWEALTH
All streams, lakes, ponds, marshes, watercourses, waterways,
wells, springs, reservoirs, aquifers, irrigation systems, drainage
systems and all other bodies or accumulations of water, surface or
underground, natural or artificial, public or private, which are contained
within, flow through or border upon the commonwealth or any portion
thereof.
