PERSON
Any natural person, partnership, firm, association, organization or corporation.
The singular shall include the plural and the masculine shall include the feminine and the neuter.

No person within the Borough shall wilfully make or cause to be made any loud boisterous or unseemly noise or disturbance to the annoyance of any other person, provided, nothing in this section shall restrict or limit the normal use to be made of parks, recreation places, playing fields and playgrounds in the Borough.

No person shall make or cause to be made or permit to be made any noise of any kind by crying, calling or shouting or by means of any whistle, rattle, gong, horn, drum or similar mechanical or electronic device or loud playing of phonograph records, tapes or radios, for the purpose of advertising any goods, wares or merchandise or attracting the attention or inviting the patronage of any person to any business whatever in the Borough of Wellsboro.

No person in the Borough shall, for commercial purposes or in connection with any commercial enterprise, erect or locate any device or apparatus in front of or on the exterior of premises owned or occupied by him which, by mechanical or electrical means emits any loud sounds or noises so as to annoy or disturb any passers-by on the street or the general public. Provided, the provisions for this section shall not apply in time of emergency to any announcement or broadcast of any current event of public interest.

No person shall operate or cause to allow to be operated upon the premises owned or occupied by such person within the Borough of Wellsboro or upon the streets of said Borough, any gas engine, gasoline engine or steam engine with an exhaust, or any compressor, or any other machinery or mechanical device of any kind whatsoever, including trucks, automobiles, motorcycles and motorbikes, making a noise that shall be offensive to any of the inhabitants of the Borough. Any person operating any such engine, machine or mechanical device shall cause the exhaust therefrom to be so muffled, controlled or insulated that it shall make no noise that will be offensive to any of the inhabitants of the Borough.

Any person owning or housing a dog or other pet animal within the Borough shall make reasonable attempts to curb or quiet the said animal from prolonged barking or howling, particularly during the night hours, so that such animal shall not unduly disturb other persons.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine not to exceed $1,000 plus costs and, in default of payment of said fine and costs, to imprisonment for a term not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.

From and after the adoption and legal publication of this Part, no person, firm, corporation, society or association shall play, cause to be played or permit or allow the playing of any musical instrument or instruments, singly or in combination or any "jukebox" or musical making device of any kind or nature in the Borough of Wellsboro, Tioga County, Pennsylvania, on any day between the hours of 2:00 a.m. and 6:00 a.m. Provided, however, that the provisions of this Part 3B shall not apply in any case where a permit has been granted by the Mayor for the holding of a dance or theatrical exhibition, as provided for in Ord. 338 [Chapter 13, Part 5].
