For the purpose of this Part, the following definitions are established:
GARAGE SALE
A public sale of goods conducted in a residentially associated garage.
HOME SALE
A public sale of goods including, by appointment, conducted in any portion of a residence.
LAWN/YARD SALE
An outdoor public sale of goods on residential property.
PERSON
Any person, association, partnership, corporation or firm.

In this Part, the singular shall include the plural, the plural shall include the singular and the masculine shall include the feminine and the neuter.

It shall be unlawful for any person to hold a garage sale, lawn/yard sale or home sale without first obtaining a license in compliance with the provisions of this Part.

Applicants for a license under this Part must file with the Borough Secretary an application in writing, on a form to be furnished by said Borough official, which shall give the following information:
A. 
Name and address of applicant(s).
B. 
Type of sale.
C. 
Items to be sold.
D. 
Dates of sale.
E. 
Location of sale.
F. 
A statement affirming that the goods to be sold belong to the applicant(s) or his/her household and that said goods have not been purchased or obtained solely for this sale with the exception of charities and service organization.

The license fee for any sale governed by this Part which is sponsored by a charitable or service organization shall be on a no-fee basis.
2. 
The license fee for garage sales, lawn/yard sales and home sales shall be a no fee basis.

Upon payment of license fees as set forth in § 13-104, above, and upon determination by the Borough Secretary that the application meets all the requirements for a license, the Borough Secretary shall issue a license.

A license for a garage, lawn/yard or home sale shall be valid for three days.

The license shall be displayed at all times during the sale. Licensee may display/erect a sale sign only at the location of sale during the license period. All signs are to be removed promptly at the conclusion of the sale.

Garage sales, lawn/yard sales and home sales licenses shall be limited to two licenses per calendar year per residence.
2. 
It shall be unlawful to bring in and sell goods belonging to others or to purchase items specifically to sell in said garage sale, lawn/yard sale or home sale, with the exception of such sales conducted on behalf of charitable or service organizations.

Garage sales, lawn/yard sales and home sales may be held only between 9:00 a.m. and 6:00 p.m.

A license granted under this Part does not permit encroachment on the right-of-way (sidewalk or street).

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof, shall be sentenced to a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.
