The following words and terms as used in this Part shall have
the meanings hereby ascribed thereto, unless the context clearly hereof
indicates a different meaning:
ASHES
The residue from the burning of wood, coal, coke and other
combustible materials.
COMBUSTIBLE REFUSE
Includes papers of all kinds, straw, excelsior, rags, rubber
and such other refuse as may result from ordinary housekeeping or
commercial pursuits and which may be burned by fire, excluding garbage.
GARBAGE
The animal or vegetable refuse from the preparation, cooking
and/or consumption of foods.
INCOMBUSTIBLE REFUSE
All discarded articles or materials except sewage, liquid
waste, garbage and combustible refuse.
PERSON
A natural person, firm, partnership, association or corporation.
REFUSE
Garbage, ashes or rubbish as herein defined.
RUBBISH
All waste materials not included in garbage and ashes, except
building rubbish from building construction, industrial refuse, dead
animals, abandoned large vehicles or other machinery or such other
waste materials as are not commonly produced in most stores and institutions.

1. After the effective date of this Part, garbage, rubbish and ashes
accumulated in the Borough of Wellsboro shall be collected, transported
and disposed of only by agents or employees of the Borough of Wellsboro
or licensed contract haulers, except for such businesses and industries
as the Borough Council, in its discretion, shall specifically license.
This section shall not be construed to prohibit a resident from transporting
his/her garbage.
2. Residents of the Borough of Wellsboro may transport and dispose of
tree limbs, brush, shrub clippings, leaves and other similar natural
vegetable matter at the Meade Street dump site, subject to such rules
and regulations as the Borough Council and the Department of Environmental
Protection may, from time to time, enact.
3. Residential garbage shall be collected weekly on the day of collection
as established by the Borough.
4. Business garbage shall be collected weekly or as otherwise established
by the Borough Council or its designated agent.
5. The Borough shall schedule two clean-up weeks, one in the Spring
and one in the Fall, during which time there will be no additional
charge leveled for pick-ups collected on the regularly scheduled collection
day.

1. Provisions for Residences.
A. Garbage, ashes and rubbish shall be placed in plastic garbage bags
or such other containers which are acceptable to the Borough Council
or its designated agent. Said garbage bags shall be of a minimum thickness
of 2.5 mils/2-ply and of such a maximum capacity of 30 gallons. In
any event, the garbage bags shall be of such capacity to provide for
normal handling by one person. All garbage, before being placed m
said garbage bags, shall have drained from it all free liquid.
B. It shall be the duty of the resident (unless specifically exempted
by the Borough Council or its designated agent, due to health infirmities
or such other reason as the Council, in its discretion, warrants exemption)
to have refuse in garbage bags placed at curbside along the streets
on the days of collection or at a satisfactory location to the Borough
Council or its designated agent.
C. Each household shall be charged at a rate in an amount to be established
from time by resolution of Borough Council.
2. Provisions for Businesses.
A. Any nonresidential property which consistently uses over four bags
of garbage per week shall place said garbage, ashes and rubbish in
a metal dumper container of 1/2 to three cubic yards capacity. Said
metal dumper container shall be of a type approved by the Borough
Council and/or its designated agent. Said metal dumper container shall
be placed in a convenient place for ease of deposit of garbage or
the collection thereof, said location to be satisfactory to the Borough
Council or its designated agent.
B. Small businesses with low garbage volume may share the use of a metal
dumper container whenever possible. Arrangements for joint use to
be approved by the Borough Council or its designated agent. Charges
for joint use shall be prorated as the joint users mutually agree.
C. Businesses shall be charged at rates in amounts as established from
time to time by resolution of Borough Council.
D. Credit for tax shall be applied against all additional charges as
follows, to wit: the credit shall be computed by multiplying the business's
assessed real estate valuation by millage to be established by the
Borough Council. Once weekly garbage collection fee shall be deducted
from said tax credit. This credit shall be for the business actually
served. If, in the event one assessed property contains more than
one business, the tax credit shall be prorated.
E. Tax exempt properties shall be charged for all weekly garbage collections.
Said tax exempt property, in any event, shall receive no tax credit
nor an allowance for any free collection.

1. Charges for collections shall be paid to the Borough of Wellsboro
directly. Prompt payment for garbage collection service is expected.
There shall be a penalty of 10% added to any garbage collection service
bill which is not paid on or before the date on which it is due and
payable.
2. Billings for garbage collection, as provided for herein, shall be
made by the Borough in accordance with regulations as established
by the Borough Council, and such bills shall be due and payable no
later than 20 days from the date of billing.
3. All garbage collection charges and penalties thereon remaining unpaid
after three months from the date on which they are due and payable
shall be deemed to be delinquent for purposes of this chapter. Delinquent
garbage collection service charges and penalties hereon shall be liens
against the respective properties served and may be entered as liens
against such properties in the Office of the Prothonotary of Tioga
County and collected in the manner prescribed and provided for by
law regarding municipal liens.
4. Usage charges for garbage collection shall be subject to the following
monthly minimum charges:

1. All refuse, whether residential or business, shall not be brought
into the Borough of Wellsboro from municipalities outside the boundaries
of the Borough.
2. All refuse, placed in plastic bags or in metal dumper containers,
shall have been derived solely from within the Borough.

1. No person shall place any refuse in any street, alley or other public
place within the Borough except in proper receptacles for collection
as set forth herein or under express approval granted by the Borough
Council.
2. Any unauthorized accumulation of refuse amounting to a public nuisance
is hereby prohibited. Failure to remove same after two days written
notification to the owner or occupier by the Borough Council or its
representative thereof shall be a violation of this chapter and, in
addition to the other penalties provided for herein, the Borough shall
remove the refuse and the expenses thereof shall be collected from
the owner or occupier in an amount equal to twice the cost of removal,
such expense to be collected by action of law or by the filing of
municipal lien.
3. It shall be the duty of the Borough of Wellsboro to enforce the provisions
of this Part and to secure compliance herewith.
4. Any person violating any provision of this Part shall, upon conviction
thereof, be sentenced to pay a fine not to exceed $1,000 plus costs
and, in default of payment of said fine and costs, to imprisonment
for a term not to exceed 30 days. Each day that a violation of this
Part continues shall constitute a separate offense.

1. For the purpose of this Part, the following definitions are established:
COMBUSTIBLE REFUSE
All paper, straw, excelsior, rags, rubber, shoes and such
other refuse as may result from ordinary housekeeping or commercials
pursuits and which may be burned by fire.
GARBAGE
All table refuse, animal and vegetable matter, offal from
meat, fish and fowls, vegetables and fruits and parts thereof and
other articles and materials ordinarily used for food and which have
become unfit for such use for which reason they are discarded.
INCOMBUSTIBLE REFUSE
All discarded articles or materials except sewage, liquid
wastes, garbage and combustible refuse.
PERSON
Any person, association, partnership, corporation or firm.
REFUSE
All combustible refuse and incombustible refuse referred
to collectively.
RUBBISH
All miscellaneous waste material not otherwise included herein
such as ashes, tin cans, glass, pottery, prunings from vines and junk
of all kinds resulting from the ordinary conduct of business or housekeeping.
2. In this Part, the singular shall include the plural, the plural shall
include the singular and the masculine shall include the feminine
and the neuter.

From and after the effective date of this Part and for reasons
of health and sanitation, it shall be unlawful for any person to accumulate
or permit to accumulate any garbage, refuse, combustible or incombustible
refuse or rubbish.
