Every owner of property in the Borough of Wellsboro shall, on 30 days' notice from the Borough Council, construct or reconstruct a sidewalk and/or curb, which shall conform to all applicable requirements of this Part in front of or alongside such property.

Every owner of property in the Borough of Wellsboro shall, on 10 days' notice from the Borough Council, repair the sidewalk and/or curb, in the manner stipulated in such notice, in front of or alongside such property.

All sidewalks and curbs shall be constructed, reconstructed and repaired of concrete only, according to specifications adopted from time to time by the Borough Council. Where a driveway leads across any sidewalk, the concrete of such sidewalk shall not be covered with any other material; provided, any existing sidewalk, built of stone, may be repaired with stone but whenever, in the opinion of the Borough Engineer, the condition of such sidewalk is such that its reconstruction, rather than repair, is necessary, such sidewalk shall be reconstructed of concrete.

All sidewalks shall be of the width determined by the Borough Council and specified in the notice referred to in § 21-201 of this Part. At its discretion, the Council may provide m any instance that only a part of the full width of any sidewalk be paved and that a grass plot, of the width specified in such notice, be maintained between the curb and the paved portion of such sidewalk. At any time when, in the judgment of the Council, it is deemed necessary that any such sidewalk be paved to its full width, with such grass plot eliminated, the Council may direct that the sidewalk on any street or alley or part thereof be reconstructed so as to be paved to its full width. In such case, the procedure established by law and by this Part for reconstruction of sidewalks shall be followed.

All sidewalks and curbs shall be constructed, reconstructed and repaired and the grading thereof shall be done upon the established line and grade, which shall be obtained by the property owner from the Borough Engineer.

The Borough Engineer, at any time during the course of work of constructing, reconstructing or repairing any sidewalk and/or curb, may visit the site of such work to ascertain whether such work is being done according to the applicable requirements; and he shall visit any such site for such purpose whenever requested by the property owner. Within two days after the completion of the work of construction, reconstruction or repair of any sidewalk and/or curb, it shall be the duty of the owner of the property where such work was done to notify the Engineer of such completion, so that he may inspect such sidewalk and/or curb in order to determine whether the proper line and grade has been observed and followed and whether the work conforms to other applicable requirements and specifications.

Any property owner, upon his own initiative, and without notice from any Borough authority, may construct, reconstruct or repair a sidewalk and/or curb in front of or alongside his property, provided that such owner shall first make application to the Borough Engineer and conform to the requirements of this Part as to line and grade and as to material used, and he shall also notify the Borough Engineer, as required by § 21-207 of this Part, within two days after completion of the work.

Any property owner shall be required to obtain a permit, at no cost, from the Borough of Wellsboro prior to the construction, reconstruction or repair of any sidewalk or curb within the Borough of Wellsboro. The permit requirement shall be applicable whether the property owner proceeds upon his/her own initiative or upon direction from the Borough of Wellsboro.

Every sidewalk and curb, when constructed, reconstructed or repaired shall conform in every respect to the provisions of this Part and the specifications, lines and grades furnished as provided herein. In any case where the Borough Engineer shall ascertain, during the course of or after the completion of such work, that any sidewalk and/or curb shall not conform to the applicable requirements, specifications, lines and grades, he shall direct the owner of the property to cause any deficiency or error to be corrected and, in default thereof, the Council shall notify the owner of such property, in the manner provided by law to correct such deficiency or error. If the same shall not be corrected within 10 days' notice, the Borough shall cause such work of correction, whether involving a repair or a reconstruction of such sidewalk and/or curb to be done and shall collect the cost thereof, with an additional amount of 10% from the owner of such property, in the manner provided by law.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
