Pursuant to General Municipal Law § 209-m, the powers
of the Mayor of the Village of Dansville, the chief executive officer
of said Village, to grant a request to provide police assistance,
including forces, equipment and supplies to any other local government
properly requesting same, is hereby delegated to the Chief of Police
of the Village of Dansville, and if he is not then on duty then also
to each police officer of said Village then on duty.
The Chief of Police and/or each police officer of the Village
of Dansville then on duty may grant said request for police assistance
from another local government, in his sound discretion, but only if
such request complies with both General Municipal Law § 209-m,
and with all of the Village of Dansville's Police Department's
then-existing policies and procedures, and if the records of the Dansville
Police Department indicate that the person so requesting assistance
has been properly delegated in writing the right to request such assistance
for his local government.
As provided in Subdivision 5 of § 209-m of the General
Municipal Law:
A. The local
government requesting police assistance from the Village of Dansville
shall assume and be fully responsible for all damages to property
and injury to person of the requesting agency, of employees and property
of the Village of Dansville, as well as of all third parties, arising
out of any act performed by employees or agents of the Village of
Dansville in rendering such aid; and
B. The requesting
local government shall reimburse the Village of Dansville for any
monies paid by the Village of Dansville for salaries or for other
expenses incurred by the Village of Dansville, including but not limited
to the damage to or loss of equipment and supplies, except to the
extent the Mayor of the Village of Dansville decides on a case-by-case
basis that the Village of Dansville shall assume same or donate the
services of the Village of Dansville police officers to the requesting
local government.
