No water shall be supplied for internal or external use to any residential, commercial, industrial, agricultural, recreational, governmental or public use of any kind wherein such water will be supplied to new construction in which plumbing, water piping or water fixtures are to be installed, extended or altered unless the new, extended or altered plumbing, water piping or other water use fixtures therein conform to the requirements of this article. "New construction" shall be defined as construction that requires a zoning permit issued after the effective date of this article.
A. 
Water closets and associated flushing mechanisms. The water consumption of water closets shall not exceed an average of 1.6 gallons per flush cycle over a range of test pressures from 20 to 80 psi. The fixture shall perform in accordance with the test requirements of the ANSI A112.19.2M and ANSI A112.19.6M.
B. 
Urinals and associated flushing mechanisms. Urinal water consumption shall not exceed an average of 1.5 gallons per flush cycle over a range of test pressures from 20 to 80 psi. The fixture shall perform in accordance with the test requirements of the ANSI A112.19.2M and ANSI A112.19.6M.
C. 
Showerheads. Showerhead discharge rates shall not exceed 3.0 gallons of water per minute over a range of test pressures from 20 to 80 psi. The fixture shall perform in accordance with the test requirements of the ANSI A112.19.1M.
D. 
Faucets. Sink and lavatory faucet discharge rates shall not exceed 3.0 gallons of water per minute over a range of test pressures from 20 to 80 psi. The fixture shall perform in accordance with the test requirements of the ANSI A112.19.1M.
A. 
Special purpose equipment. The performance standards of § 304-2 shall not apply to fixtures and fittings such as emergency showers, aspirator faucets and blowout fixtures that, in order to perform a specialized function, cannot meet the specified standards.
B. 
Exemptions. Any person may apply to the Delaware River Basin Commission for an exemption. Once approved by the DRBC, the exemption will be recognized by the Borough.

Any person who violates or permits a violation of this article shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys’ fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this article in equity in the Court of Common Pleas of Pike County.

As used in this article, the following terms shall have the meanings indicated:
AUTHORITY
A body corporate and politic organized under the Municipality Authorities Act of 1945,[1] as amended, incorporated by the Borough of Milford (see Chapter 14, Municipal Authorities).
IMPROVED PROPERTY
Any property with the Borough of Milford upon which there is erected a structure intended for continuous or periodic habitation, occupancy or use by humans or animals.
PRODUCTION WELL
A water well designed for the consumption of water (as opposed to a well, for example, designed to monitor groundwater or circulate water for use in a heating system). A production well shall include, but not be limited to, wells used to provide water for human consumption or animal consumption or filling a swimming pool or the watering of plants or grass or any combination thereof.
WATER SYSTEM
All facilities, as of any particular time, for production, transmission, storage and distribution of water in the Borough of Milford owned by the Authority.

The owner of any improved property within the Borough shall connect or continue connection with and shall use such water system, as defined herein, subject to the rules and regulations of the Authority and of this article. Such connection shall be made prior to the occupancy of any structure hereafter constructed or completed within the Borough of Milford. Production wells, as defined herein, may not be dug in the Borough of Milford.
