The Mayor, with the consent and approval of a majority of the members elected to the City Council, shall have the power to appoint a part-time City Engineer for a term of one (1) year at the first regular meeting of the Council in which the newly elected members shall sit after the annual City election in April, provided that should such appointment not be made at such meeting, it may be made at any subsequent meeting of the Council, for a term to terminate not later than the first regular meeting after the next annual City elections in which the newly elected members of the Council shall participate.

The Engineer appointed as provided in this Article shall be registered by the State Board of Registration.

Before entering upon the duties of his or her office, the City Engineer shall take upon himself and subscribe to an oath or affirmation before some court of record of the County, or the Clerk of the City or the Municipal Judge of the same, that he/she possesses all of the qualifications prescribed by law for his or her office; that he/she will support the Constitution of the United States and of the state, the provisions of all the laws of this State affecting cities of the third class and the ordinances of the City, and faithfully demean himself in office, which official oath or affirmation shall be filed with the City Clerk.

The compensation to be paid to the part-time City Engineer shall be fixed by ordinance or resolution of the City Council, but he/she shall not be employed more than fifteen (15) days per month.

A. 
The City Engineer shall:
1. 
Make and file with the City Clerk all plans, specifications and estimates that may be necessary for the letting of contracts for construction of City projects or that may be necessary for the doing of work when it is not by contract;
2. 
When so ordered by the Mayor or Council, prepare such plans, specifications, estimates and profiles, make such surveys, compile such data and submit such reports to the Mayor or City Council concerning projects or improvements which may be under consideration as the Mayor or Council may order;
3. 
Make tests of materials used in the construction or reconstruction of streets, the building of sidewalks and curbing, the oiling of streets and such other City work as may be necessary;
4. 
Recommend the grade, quality and kind of materials used in the doing of work for the City including road oils, asphalt, concrete, cement, sand and rock;
5. 
Supervise and inspect all construction work of the City, without assuming control over or direction of any person who may be employed by a contractor in the doing of work for the City;
6. 
Make such street, sidewalk, sewer, curb and drainage surveys, as the Mayor or Council may order, and report the proper grade to be established;
7. 
Upon the completion of any work, the acceptance of which shall require the approval of the City Engineer, the Engineer, if he/she shall approve the same, shall submit such approval in writing to the Council;
8. 
Upon application, give the grade for sidewalks to be constructed with the City, and upon completion of any sidewalk if he/she shall find the same to have been built on grade, he/she shall file with the City Clerk and furnish the owner his or her approval thereof in writing;
9. 
Prescribe rules and regulations for the tapping of any public or district sewer by private parties, shall supervise and inspect any connections which may be made and shall approve the same in writing if he/she shall find them to have been properly made;
10. 
Perform such duties as are required by the laws of the State, of a City Engineer of a City of the third class, and as required by the ordinance of the City, and such other duties in addition to those set out, as he/she may, by the City Council or director of municipal services be ordered to perform.

The City shall furnish such instruments, equipment, field note books, drawing paper and other materials as shall by the Council be deemed necessary, but all plats, profiles, maps, surveys, estimates, specifications, field notes, books and note books of data as may be made, compiled or begun by said Engineer on City work, shall be the property of the City.
