A. 
At the first meeting of the newly elected Council after the annual City election, or as soon thereafter as practicable, it shall be the duty of the Mayor, with the consent and approval of a majority of the members elected to the City Council, to appoint some suitable and competent person to the office of director of municipal services, who shall be a resident of the City and who shall hold his or her office for a term of one (1) year and until his or her successor is appointed and qualified.
B. 
Before entering upon the duties of his or her office, the director shall take and subscribe an oath that he/she possesses all the qualifications prescribed by law for his or her office, that he/she will support the constitutions of the United States and of the state, all laws of the state, affecting cities of the third class and the ordinances of the City, that he/she will faithfully demean himself in office, and that he/she is not and will not during his or her term of office be either directly or indirectly interested in any contract with the City for any public work or material furnished, which official oath shall be filed with the City Clerk.
C. 
The Director of Municipal Services shall serve as the Street Commissioner and the City Traffic Engineer. All references in the Code of Ordinances of the City of Marshall, Missouri, to the "Street Commissioner" or City Traffic Engineer shall mean the "Director of Municipal Services."
D. 
The Mayor shall, from time to time, with the consent and approval of a majority of the members elected to the City Council, appoint some suitable and competent person to serve as the Assistant Director of Municipal Services. It shall be the duty of the Assistant Director of Municipal Services to perform the duties delegated to him by the Director, and any acts required in the Code of Ordinances to be performed by the Director may be delegated by him to the Assistant Director.
E. 
In addition to the various duties set forth in the Code of Ordinances, the Director of Municipal Services shall be responsible for all recordkeeping, coordination and administration of street maintenance, street construction, street sweeping and sign construction, equipment maintenance, administration of the City vehicle fuel system, residential and commercial refuse collection, operation of the City landfill, grant applications and administration on projects relating to the functions of the department and engineering-related duties.
F. 
The Director of Municipal Services may be removed from office in the manner prescribed for the removal of appointive officers of the City.

The Director of Municipal Services, by and with the advice and consent of the Council, is hereby authorized and empowered to use such laborers, mechanics, vehicles, carts and teams, and to purchase such materials and tools as from time to time may be necessary in the proper discharge of his or her duties; provided, that the wages of laborers and mechanics and the compensation allowed for vehicles, carts or teams so used shall in no event, exceed the rate of compensation usually paid in the City for similar services at the time of such use.

The Director of Municipal Services shall have the care and custody of all tools, machinery, implements and other property of the City under his or her control in the performance of his or her duties, and shall be held responsible for their loss or abuse and upon vacating his or her office he/she shall cause the same to be turned over to his or her successor in office, or to the committee on streets, alleys, sidewalks and sewers if his or her successor shall not have been appointed and qualified and he/she shall take duplicate receipts for all property so transferred; one copy of which he/she shall file with the City Clerk.

The Director of Municipal Services shall keep an accurate, itemized account of all purchases made by him and of all services rendered by those in his or her employ or under his or her control, and shall certify to the correctness of all accounts for purchases made by him, and for services rendered by the persons, vehicles, carts and teams under his or her control.

The Director of Municipal Services shall cause to be prosecuted every person he/she may find violating any ordinance of the City relating to streets, alleys, sidewalks, sewers or other public property of the City and shall make arrests of all persons violating such ordinances and bringing them before the Municipal Judge.

The Director of Municipal Services shall perform such other duties as may hereafter be prescribed by ordinance or resolution of the Council.
