It shall be unlawful for any person to use, burn, explode or set off any firecracker, torpedo, bomb, rocket, pinwheel, fire balloon, roman candle, toy cannon, or any other firecracker or fireworks within the City, except as provided in Section 203.320.

The Fire Chief is hereby authorized with consent of the City Council to issue temporary permits for fireworks displays to be held in such places as, in the opinion of the Fire Chief, shall provide maximum protection against noise pollution, personal injury and property damage, and under direct supervision and control of such persons as the Fire Chief shall deem competent for such purposes. The Fire Chief may revoke the temporary permits at any time he/she feels that injury to persons, property or the public welfare may be threatened.

A. 
On July 4 of each year, from 10:00 A.M. to 11:00 P.M. and on December 31 of each year, from 10:00 A.M. to January 1 at 12:30 A.M., subject to the limitations contained herein, it shall be lawful for any person to use and discharge consumer fireworks. As used herein, the term "consumer fireworks" means any explosive devices designed primarily to produce visible or audible effects by combustion and includes aerial devices and ground devices, all of which are classified as fireworks, UNO336, within 49 CFR, 172. The following uses of consumer fireworks shall be prohibited:

It shall be unlawful for any person to discharge or possess any fireworks upon public land or in any public park, owned by the City; provided, however, that nothing in this Article shall be deemed to limit the authority of the City to allow an event display of display fireworks;
2. 
It shall be unlawful to ignite, explode, or discharge consumer fireworks within six hundred (600) feet of any church, hospital, mental health facility, or school;
3. 
It shall be unlawful to ignite, explode, or discharge consumer fireworks within three hundred (300) feet of any permanent storage of ignitable liquid, gases, gasoline pump, and gasoline filling station; and
4. 
It shall be unlawful to ignite, explode, or discharge within or throw the same from or into a motorized vehicle including watercraft or any other means of transportation or at or near any person or group of people.

It shall be unlawful for any person to sell or expose for sale any firecracker, torpedo, bomb, rocket, pinwheel, fire balloon, roman candle, toy cannon or any other firecracker or fireworks within the City.

Except as set forth in Sections 203.320 and 203.330, it shall be unlawful for any person to have in his possession an opened package of any packaged fireworks or individual firecracker, torpedo, bomb, rocket, pinwheel, fire balloon, roman candle, toy cannon or any other firecracker or fireworks within the City.

It shall be unlawful for any person to store over fifty dollars ($50.00) worth of the following materials: firecracker, torpedo, bomb, rocket, pinwheel, fire balloon, roman candle, toy cannon or any other fireworks within the City, except as provided in Section 203.370.

The Fire Chief is hereby authorized with consent of the City Council to issue temporary permits to store any of the following materials: firecracker, torpedo, bomb, rocket, pinwheel, fire balloon, roman candle, toy cannon or any other firecracker or fireworks. Such items shall be stored in such manner as the Fire Chief shall specify to provide maximum protection against personal injury or property damage. The Fire Chief may revoke the temporary permits at any time he/she feels that injury to persons, property or the public welfare may occur.
