A certain document, one (1) digital copy of which is on file in the office of the Clerk of the City of Marshall, being marked and designated as the International Fire Code, 2015 edition, including Appendix Chapters B, C, D, E, and F, as published by the International Code Council, be and is hereby adopted as the Fire Code of the City of Marshall, Missouri, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices; and from conditions hazardous to life or property in the occupancy of buildings and premises in the City of Marshall, Missouri; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the Clerk of the City of Marshall, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any prescribed in Section 203.280.

Wherever reference is made to the fire prevention bureau in the fire prevention code adopted in Section 203.260, such reference shall be deemed to mean and refer to the Fire Department of the City.

The sections of the Fire Code are hereby revised:
1. 
Section 101.1. Insert: The City of Marshall, Missouri.
2. 
Section 108.1. Revised to read:
108.1 General. Appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this Code shall be heard by the City of Marshall Board of Appeals, as established, adopted and amended from time to time by the City of Marshall, Missouri. The Board of Appeals shall follow the practices and procedures followed by the Board of Code Enforcement.
3. 
Section 108.3. Revised to read:
108.3 Qualifications. The Board of Appeals shall consist of not less than four (4) members who are qualified by experience and training to pass on matters pertaining to building construction, fire protection or other areas of construction, property maintenance or building trades. Officers and/or employees of the City of Marshall, Missouri, may serve as members of the Board of Appeals. The Board of Appeals shall follow the practices and procedures followed by the Board of Code Enforcement.
4. 
Section 109.4. Insert: Ordinance violation, five hundred dollars ($500.00), ninety (90) days.
5.

The manufacture, display, sale, possession or discharge of fireworks shall comply with the provisions of City Ordinance No. 5745, as adopted on October 19, 1981, and, to the extent not inconsistent with Ordinance No. 5745, with the provisions of this chapter.

That the geographic limits referred to in certain sections of the 2015 International Fire Code are hereby established as follows:
1. 
Section 5704.2.9.6.1 (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited): No applicable limit other than as set forth in this Code and other codes and ordinances of the City of Marshall, Missouri.
2. 
Section 5706.2.4.4 (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks is prohibited): No applicable limit other than as set forth in this Code and other codes and ordinances of the City of Marshall, Missouri.
3. 
Section 5806.2 (geographic limits in which the storage of flammable cryogenic fluids in stationary containers is prohibited): No applicable limit other than as set forth in this Code and other codes and ordinances of the City of Marshall, Missouri.
4. 
Section 6104.2 (geographic limits in which the storage of liquefied petroleum gas is restricted for the protection of heavily populated or congested areas): No applicable limit other than as set forth in this Code and other codes and ordinances of the City of Marshall, Missouri.

A. 
It shall be unlawful for any person, either directly or indirectly, to conduct or maintain any temporary amusement facility, or to use in connection therewith any vehicle, premises, machine or device in whole or in part, without first obtaining a license or permit therefor.
1. 
In addition to all other requirements for the issuance of such license or permit, the City Clerk shall not issue said license or permit without first obtaining the certification of the Fire Chief that the facility meets all safety requirements applicable to temporary amusement facilities.
2. 
Before endorsing his approval of any such license the Fire Chief, or his designated representative, shall inspect such facility to ensure that the facility does not create an unreasonable risk of fire.
3. 
The Fire Chief is hereby authorized to establish minimum firesafety standards for temporary amusement facilities.
