No person shall set, permit, or maintain any outdoor fire within
the Borough, nor burn or cause to be burned within the Borough any
paper, boxes, rubbish, leaves, or other material or substance of any
kind except as provided by this chapter.
Outdoor fire shall be permitted upon private property, provided
that the following regulations and restrictions are strictly adhered
to:
A. Every such outdoor fire with the exception of leaves or brush shall
be built in and confined to a noncombustible container covered with
a screen of 1/2 inch or smaller mesh, or other suitable noncombustible
container.
B. No such fire shall be closer than 15 feet from any building or five
feet from any property line.
C. Every such outdoor fire permitted by this chapter shall be supervised
at all times by a responsible person, and shall not be left unattended.
D. No such fire shall be allowed to burn on any Saturday (except between
the hours of 9:00 a.m. and 4:00 p.m.), any Sunday, any legal holiday,
or after 7:00 p.m. or before 9:00 a.m. on any day.
E. Recreational burning, defined as a camp fire and/or small fire used
for recreational use/cooking shall be permitted any day within the
Borough utilizing chimeneas and/or manufactured fire pits or containers
made of steel or brick, as long as said item is at least five feet
from any combustibles and real estate property lines, with the container
to be no larger than three feet in diameter and two feet in height.
Material to be burned shall be dried wood/charcoal, minimizing smoke
and noxious or offensive fumes or odors. Flames from such fire shall
be no higher than three feet from the ground and a fire must be fully
extinguished before being left unattended. In the event of a violation
of this subsection, the Code Enforcement Officer, the Avis Borough
Mayor, or a duly authorized police officer shall have the discretion
to have the fire extinguished by the Avis Fire Company, along with
any other remedies available in this chapter. Fund-raising activities
for nonprofit organizations, such as chicken barbecues, are exempt
from the provision of this subsection.

The burning of garbage, rubber, grease, hair or any other material
that may cause an offensive odor shall not be permitted under the
terms of this chapter; fire permitted under this chapter shall consist
solely of the burning of paper, paper products, leaves and wood products.
Special permission for the burning of old buildings and fields
may be obtained from the Mayor of the Borough, provided adequate firesafety
measures are used.

Any person who shall violate any provision of this chapter shall,
upon conviction thereof, be sentenced to pay a fine not exceeding
$600 and costs and, in default of payment thereof, shall be subject
to imprisonment for a term not to exceed 30 days. Each day that a
violation of this chapter continues shall constitute a separate offense.
