The owner or agent for each complex containing five or more
rental units shall submit annually in January a certified tenant listing
in a format acceptable to the Township Clerk which includes the unit
number of each apartment, tenant(s) name and date tenant(s) occupied
the unit.
The owner or agent for each complex containing five or more
rental units shall, upon demand, submit to the appropriate Township
official copies of the State of New Jersey inspection cards (also
known as "green cards") for any of his or her units.
All summonses issued for property maintenance or code violations
at complexes containing five or more rental units shall require a
mandatory court appearance for any repeat violations.
In addition to the inspections and certificates of occupancy
required presently, for all complexes containing five or more rental
units, the Township will have the right to inspect 10% of the rental
units annually. In the event that a particular complex or site has
experienced an inspection failure rate of 70% or more during the previous
twelve-month period, the Township shall have the right to inspect
more than 10% of the units.
Common spaces and public areas shall be subject to inspection
at any time that an individual rental inspection is being conducted
at any complex containing five or more rental units.
Recreational equipment at all complexes containing five or more
rental units shall be properly maintained. If the recreational equipment
was indicated upon the plans which were submitted for site plan approval,
said equipment shall not be removed without the consent of the Township
Planning Board. If the recreational equipment was not indicated upon
the plans which were submitted for site plan approval and is no longer
operational, it shall either be removed or be enclosed so as not to
present a danger to the public.
If at any time a rental inspector suspects a structural deficiency
at a complex containing five or more rental units, that inspector
shall notify the Construction Official of the Township and request
that the Construction Official undertake an inspection. In the event
that the Construction Official finds evidence of a structural deficiency,
the owner of the property or the owner's agent shall be required to
have a licensed professional architect or a licensed professional
engineer undertake an analysis of the suspected deficiency and provide
a certified report of his or her findings to the Construction Official.
