Upon due notice from the proper officials from the Borough of Paramus in the County of Bergen, State of New Jersey, as designated in the Agreement hereinafter set forth, that the said Borough of Paramus authorizes the officials named in said Agreement to execute said Agreement and that the Mayor and Council of the Borough of Paramus has or will enact the necessary ordinance authorizing the Borough of Paramus to enter into said Agreement, and the filing of a certified copy of said resolution or said ordinance so authorizing after the same is legally passed or adopted with the Clerk of the Borough of River Edge, the Borough of River Edge is authorized to enter into the proposed Agreement as hereinafter incorporated in this chapter in §
45-2 hereof with the Borough of Paramus, County of Bergen, State of New Jersey. The execution of said Agreement by the Borough of River Edge shall take place after this chapter shall have been legally adopted and become effective according to law and after the proper notification has been received by the Borough of Paramus.
The Agreement herein, authorized to be entered into pursuant to §
45-1 hereof, shall be of the following form and content, to wit:
THIS AGREEMENT, made this ______ day of __________,
1975, between the BOROUGH OF PARAMUS and the BOROUGH OF RIVER EDGE,
the parties hereby covenant and agree as follows:

WHEREAS, the municipalities herein desire services
of the Fire Departments of both municipalities in the event of an
emergency which requires assistance; and

WHEREAS, under N.J.S.A. 40A:14-66, the municipalities are enabled to enter into reciprocal
ordinances and contract with each other for mutual aid in case of
fire emergencies;

IT IS THEREFORE AGREED by and between the parties
hereto as follows:

In the event of an emergency, the chief or head
of the Municipal Fire Department of Paramus or the chief or head of
the Municipal Fire Department of River Edge or the Mayor or chief
executive officer of either municipality may request from the chief
or head of the Fire Department of the alternate municipality, assistance
to protect life and property within the jurisdiction of the Department
of the municipality making such request and which would, therefore,
be outside of the normal territorial jurisdiction of the Department
to which such request is directed.

The chief or head of the Fire Department upon
whom such request for assistance is made shall provide such personnel
and equipment as requested to the extent possible without endangering
person or property within its own municipality.

The municipality responding to such request
shall be reimbursed by the municipality making such request for any
damage to its fire equipment or other property sustained in the course
of rendering such assistance.

4.
|
The members of the Fire Department in each municipality,
while on duty and rendering such aid, shall be deemed to be engaged
in a governmental function and entitled to the same police powers,
privileges and immunities as in the case of extinguishing a fire within
its own municipality. The overall direction of any such emergency
effort, however, shall be under the authority of the requesting municipality
within whose territory the effort is being rendered.

If any member or officer of the Fire Department
rendering such assistance shall suffer any casualty or death, he or
his designee or legal representative shall be entitled to all salary,
pension rights, workmen's compensation and other benefits as if such
casualty or death occurred in the performance of his duties in his
own municipality or other jurisdiction in which his duties are normally
carried on.

The parties herein agree to pass any necessary
ordinances to effectuate the Agreement and purposes herein.

This Agreement shall be effective immediately
upon execution and passage of the necessary ordinances by the parties
hereto.

IN WITNESS WHEREOF, the parties hereto have
caused their presents to be signed by their proper corporate officers
and Fire Department chiefs and their seals affixed thereto the day
and year first above written.

Immediately after this chapter has been duly and legally adopted and has become legally effective according to law, the Mayor of the Borough of River Edge be and he is hereby authorized and directed to execute said Agreement on behalf of the Borough of River Edge, and the Borough Clerk be and he is hereby authorized and directed to attest the same and attach the official seal of the borough thereto, upon execution and delivery of said Agreement by the Borough of Paramus and upon the filing of the certified copy of the Ordinance authorizing the execution of same by the Borough of Paramus, mentioned in §
45-1 hereof.

A. The Borough of River Edge hereby establishes, pursuant to the provisions
of N.J.S.A. 40A:14-156 et seq., a reciprocal agreement with each and
every municipality within the County of Bergen, for intermunicipal
fire assistance at time of any and all emergencies.
B. This chapter shall become effective as to each and every municipality
within Bergen County at such time or times that said municipalities
have in the past or may in the future adopt an ordinance providing
the same terms and conditions set forth herein and including the Borough
of River Edge within its coverage.

The Borough of River Edge agrees to bear all reasonable expenses
incurred by members of its Fire Department for emergency assistance
rendered within or without the boundaries of this community. The Borough
of River Edge shall make no claim for reimbursement from any municipality
adopting an ordinance providing the same terms and conditions set
forth herein, for damages, injuries, wages and the like in connection
with aid rendered by the members of its Fire Department through any
other municipality adopting such ordinance.

A. Intermunicipal fire authority. In accordance with the provisions
of N.J.S.A. 40A:14-156.2, the members of the Fire Department of the
Borough of River Edge and any other municipality shall have the same
powers, authority and immunities as do the members of the Fire Department
of the municipality in which such assistance is being rendered.

At such times that an emergency may occur and intermunicipal
aid is requested, the Chief of the Fire Department of the municipality
wherein the said emergency exists shall be the senior ranking officer.
