It is hereby determined and declared that the regulation of the use of City-owned open space within the City of Port Republic will protect and benefit the public health, safety and welfare.
The following terms, phrases and words used in and or for the purpose of this article shall be deemed to have the following meanings:
November 1 through December 31 (not including Sundays) each year.
Block 11, Lot 65; Block 24, Lot 18; Block 34, Lot 3.01; Block 36, Lot 1; Block 31, Lots 1 and 2; Block 37, Lots 5 and 7; Block 692.01, Lots 1, 3, 8 and 9.
With the exception of hunting and trapping license holders, the general public is prohibited from accessing or otherwise utilizing open space properties during the hunting season.
Any trail markers or signs placed on open space properties shall be positioned so as to not block trail entryways.
The City Council is hereby authorized and empowered to:
Adopt by resolution, in addition to the rules and regulations herein enumerated, such other rules and regulations as may be necessary for the proper control and regulation of open space properties.
Employ such employees as may be necessary to carry out and enforce the provisions of this article and all rules and regulations established herein or subsequently adopted by resolution.
Purchase such supplies, materials and equipment as may be necessary.
Any person violating any of the provisions of this article shall, upon conviction, at the discretion of the court, be subject to:
A fine of not more than $2,500;
Imprisonment for not more than 90 days;
Payment of restitution in an amount in the discretion of the court; and/or
Community service in the discretion of the court.
Each day the violation shall continue shall be deemed a separate offense. A continuance of a violation or a noncompliance with the provisions of this article shall be deemed a nuisance, and the City of Port Republic shall have the right to apply to the courts of this state for injunctive relief or other relief in addition to the penalties provided for herein.
