No driveway or curb cut or other means of accessing a public street in a front or side yard within the Borough of West View R-1 and R-3 residential zoning shall be permitted unless it constitutes an access driveway leading to a garage or paved rear lot parking area. Further, said curb cut or access path shall maintain an approved line of sight regarding the street. No front yard parking shall be permitted in R-1 Zoned areas. Driveways must remain at least five feet from the abutting property. Parking and access driveways shall be set back at least 40 feet from the property line. Driveways must be no more than six feet in width. Parking areas must be at least 150 square feet in area and sufficiently buffered from surrounding property.
A curb cut shall mean any access to public streets of the Borough. In order to obtain a curb cut, the owner of the property must obtain a permit from the Borough and meet the criteria set forth in § 245-30 herein, and said access shall only be lawful if the curb cut or access leads to a garage, or paved rear parking area.
This article shall also govern access to property from the Borough alleyways, under the same terms and conditions set forth herein.
Anyone violating the provisions of this article shall be subject to a daily fine not to exceed $200 and shall take the necessary actions to bring his or her property into compliance with this article.
Any ordinance or parts of an ordinance in conflict with the provisions of this article are hereby repealed to the extent of said conflict.
