The following acts are hereby prohibited within the Borough
of West Chester:
A.
Smoking, inhaling, exhaling, burning, or carrying any lighted or
heated cigar, cigarette, pipe, or any other lighted or heated tobacco
or plant product intended for inhalation, in any manner or in any
form on or in any Borough-owned real and personal property, including
all Borough parks, municipal buildings, garages, and vehicles. This
section also applies to and includes the use of an e-cigarette or
other similar devices which create a vapor, in any manner or in any
form.
Any person found to be in violation of any provision of this
chapter shall be issued a citation and, upon conviction thereof in
a summary proceeding brought before a Magisterial District Judge,
be guilty of a summary offense and shall be subject to the payment
of a fine of $25, together with the costs of prosecution.
