"Single family structure" defined. For the purposes of this section,
a "single-family structure" is defined as being a building containing
not more that one dwelling unit designed for or used exclusively for
residential purposes.
Applicability of section. The provisions of this section shall apply
to all single-family structures for which a building permit has not
been obtained prior to January 1, 1996.
Applicability of Building Code. The Maryland Building Performance
Standards Regulations as set forth in the Code of Maryland Regulations
(COMAR) 05.02.07 shall apply to all single-family structures, except
that the provision of the International Residential Code for one-
and two-family dwellings, which requires that an automatic residential
fire sprinkler system shall be installed in one- and two-family dwellings,
effective January 1, 2011, shall not apply to the construction of
a "single family structure," as defined in this section.
Inspections. The City department designated by the City Manager shall
be responsible to perform such inspections as may be deemed necessary
and appropriate to ensure compliance with the provisions of this section.
Violations. Any person who violates the provisions of this section
shall be guilty of a municipal infraction and subject to a fine as
set forth in the Fees, Charges and Rates Schedule, adopted by resolution
of the City Council from time to time.[1]
