A. Pursuant
to an Intermunicipal agreement between the Town and Village of Mt.
Morris, as authorized by New York State General Municipal Law Articles
5-G and 5-J, a Joint Planning Board is hereby created and shall be
known as the "Town and Village of Mt. Morris Joint Planning Board."
Said Joint Planning Board shall replace the Mt. Morris Planning Board
previously created by local law adopted March 13, 1967, as amended
by L.L. Nos. 3-1997 and 2-1999. The previously created Mt. Morris
Planning Board is hereby abolished.
B. The Joint Planning Board shall consist of five members and one alternate, all to be appointed and serve as provided hereinafter at §
9-1C.
C. The
Town Council of the Town and the Mayor of the Village, subject to
the approval of the Village Board of Trustees, shall jointly appoint
each member of the Joint Planning Board and the alternate as follows;
one member to be appointed for a one-year term, one member to be appointed
to a two-year term, one member to be appointed to a three-year term,
one member to be appointed for a four-year term, one member to be
appointed for a five-year term and the annual appointment of one alternate.
D. The
Chairperson shall be jointly appointed by the Town and Village based
upon the recommendation of the Joint Planning Board. The appointment
on behalf of the Village shall be made by the Mayor, subject to the
approval of the Board of Trustees. The appointment on behalf of the
Town shall be made by the Town Council.
E. Appointments to fill any vacancies for arising from members vacating office prior to the expiration of their term shall be made within 90 days of the occurrence thereof and shall be made in the same manner as provided in §
9-1C.
F. The alternate member shall be appointed only for purposes of substituting for and serving in the place of any Joint Planning Board member unable to serve on any particular matter in the event of a conflict of interest, or for any member who is otherwise unavailable to serve on a matter for any other reason. The alternate shall also be subject to the minimum requirements set forth hereinafter at §
9-2.
A. Training.
Each Board member is required to complete three hours of training
per calendar year for a total of five hours of training during each
five-year term. Failure to comply with this requirement without good
cause shall be grounds for removal from the Board.
B. Attendance.
Each Board member shall be required to attend 75% of the scheduled
meetings in each calendar year. Failure to attend the required number
of meetings without good cause shall be grounds for removal from the
Board. In addition, failure to attend three consecutive meetings without
good cause may be grounds for removal from the Board.
The Joint Planning Board shall have the powers and duties authorized
by the New York State Town Law and those specified as follows:
A. Pursuant to and in accordance with the provisions of New York State Town Law §§ 276 and 277 and Chapter
A51 of the Code of the Town of Mt. Morris, the Joint Planning Board is hereby authorized to approve preliminary and final plats of subdivisions showing lots, blocks or sites, with or without streets or highways, and conditionally approve preliminary plats and pass and approve the development of plots already filed in the office of the Clerk of the County of Livingston if such plots are entirely or partially undeveloped.
B. Street
changes. The Joint Planning Board is authorized to approve or disapprove
changes in the lines of existing streets, highways or public areas
shown on subdivision plats or maps filed in the office of the Clerk
of Livingston County and the laying out, closing off or abandonment
of streets, highways or public areas under the provisions of the Town
or Village highway laws and the Highway Law of the State of New York.
C. Site plan. The Joint Planning Board shall have the authority to approve, approve with conditions or deny site plans pursuant to and in accordance with § 274-a of the New York State Town Law and Chapter
37 of the Code of the Town of Mt. Morris.
D. Special use permits. The Joint Planning Board shall have the authority to grant special use permits pursuant to and in accordance with the provisions of § 274-b of the New York State Town Law and Article
VIII of Chapter
48 of the Code of the Town of Mt. Morris.
