There is hereby created a Board to supervise, regulate, equip
and maintain Polk Township funded recreation programs and facilities.
The Board shall be known as the "Polk Township Recreation Board."
The Board shall consist of five residents of the Township, who
shall be appointed by the Supervisors of Polk Township for terms of
five years each or until their successors are appointed, except as
provided hereinafter. Members shall serve without pay but may be reimbursed
by the Township for all expenses incurred in performing their duties.
The members of the Board first appointed shall serve initial
terms as follows: one member shall serve an initial term which shall
expire December 31, 2000; one member shall serve an initial term which
shall expire December 31, 2001; one member shall serve an initial
term which shall expire December 31, 2002; one member shall serve
an initial term which shall expire December 31, 2003; one member shall
serve an initial term which shall expire December 31, 2004. The Supervisors
shall conduct a random drawing in connection with the initial appointments
to the Board to determine the length of each member's initial
term. Thereafter, each member or his or her successor shall serve
a term of five years commencing January 1, as provided elsewhere in
this chapter.
All persons appointed shall serve their full terms unless they
voluntarily resign or are removed by the Board of Supervisors of Polk
Township. Any Board member may be removed for dereliction or neglect
of duty or for other just cause by a majority vote of the Supervisors
of Polk Township. Vacancies occurring other than by expiration of
term shall be for the unexpired term and shall be filled in the same
manner as the original appointments.
The members of the Board shall elect a Chairman and Secretary
and select all other necessary officers to serve for a period of one
year.
The Recreation Board may adopt rules and regulations for the
conduct of all business within its jurisdiction and exercise powers
and functions concerning parks and recreation facilities as may be
delegated to it by the Board of Supervisors. The Recreation Board
is not authorized or empowered to obligate, financially or otherwise,
the Board of Supervisors of Polk Township. The Recreation Board may
make recommendations and requests to the Board of Supervisors for
funding and shall submit an annual report to the Supervisors, including
and analysis of the adequacy and effectiveness of community recreation
areas, facilities and leadership by January 31 of the next calendar
year.
The Recreation Board shall hold meetings from time to time at
the request of Chairman, a majority of the members, or the Supervisors,
at the Polk Township Municipal Building pursuant to the Pennsylvania
Sunshine Act, as the same may be amended from time to time.
If any sentence, clause, section, or part of this chapter is
for any reason found to be unconstitutional, illegal or invalid, such
findings shall not affect or impair any of the remaining sections,
sentences, clauses, or parts of this chapter. It is hereby declared
as the intent of the Township that this chapter would have been adopted
had all unconstitutional, illegal or invalid sentences, clauses, sections
or parts hereof not been included therein.
