[HISTORY: Adopted by the Board of Supervisors of the Township of Polk 2-26-1996 by Ord. No. 1996-01. Amendments noted where applicable.]
There is hereby created a commission to take charge of, care for, maintain and keep in good order and repair the Polk Township Veterans' Memorial. The commission shall be known as the "Polk Township Veterans' Memorial Commission."
The Commission shall consist of five residents of the Township, who shall be appointed by the Supervisors of Polk Township for terms of five years each, except as provided hereinafter.
The members of the Commission first appointed shall serve initial terms as follows: one member shall serve an initial term which shall expire December 31, 1996; one member shall serve an initial term which shall expire December 31, 1997; one member shall serve an initial term which shall expire December 31, 1998; one member shall serve an initial term which shall expire December 31, 1999; one member shall serve an initial term which shall expire December 31, 2000. The Supervisors shall conduct a random drawing in connection with the initial appointments to the commission to determine the length of each member's initial term. Thereafter, each member or his or her successor shall serve a term of five years commencing January 1 as provided elsewhere in this chapter.
Any Commission member may be removed for malfeasance, misfeasance or nonfeasance in office or for other just cause by a majority vote of the Supervisors of Polk Township, taken after the member has received 15 days' advance notice of the intent to take such a vote. A hearing shall be held in connection with the vote if the member shall request it in writing.
A. 
The officers of the Commission shall be a Chairman, a Vice Chairman, and a Secretary-Treasurer, which officers shall be selected by the members of the Commission from among the members of the Commission.

Officers shall hold office for one year upon selection and may succeed themselves. In the event of vacancy in any office, the same shall be filled from the membership of the Commission to complete the unexpired term.
The Commission is authorized to receive funds from persons or organizations and to expend the same to carry out the purposes of the Commission. All funds shall be subject to audit by the auditors of the Township.
The Commissioners shall report annually to the Supervisors not later then January 31 of each year on the state and condition of the memorial, the activities of the Commission during the prior year, and the receipt and expenditure of funds with respect to the memorial. Notwithstanding the foregoing, the Commission may render advice to the Supervisors from time to time on matters relevant to the memorial.
The Commission shall hold meetings from time to time at the Township municipal building pursuant to the Pennsylvania Sunshine Act, as the same may be amended from time to time.[1]

If any sentence, clause, section, or part of this chapter is for any reason found to be unconstitutional, illegal or invalid, such findings shall not affect or impair any of the remaining sections, sentences, clauses, or parts of this chapter. It is hereby declared as the intent of the Township that this chapter would have been adopted had all unconstitutional, illegal or invalid sentences, clauses, sections or parts hereof not been included therein.
