[HISTORY: Adopted by the Board of Supervisors of the Township of Polk 3-24-2014 by Ord. No. 2014-02. Amendments noted where applicable.]
The following terms shall have the following specific definitions as they pertain to this chapter:
MOVING
The relocation of any person to or from Polk Township for purposes of physical habitation for a period in excess of 30 days.
MOVING PERMIT
A permit issued by Polk Township, Monroe County, to any person moving to or from the Township.
PERSON
Any natural person as well as any legal entity such as a corporation, limited-liability company, limited liability partnership, or other similar entity.
TOWNSHIP
Polk Township, Monroe County, Pennsylvania.
A. 
No person shall move in or from the Township without submitting to the Township a moving permit application and a form approved and issued by the Township.
B. 
The moving permit application shall state the following:
(1) 
Name of the person or persons moving to or from the Township;
(2) 
The age, date of birth, and current name and address of employer for each such person;
(3) 
The former address and intended address of each such person; and
(4) 
The date upon which such person or persons moved into or departed the Township.
C. 
Such moving permit application shall be submitted to the Township within seven days of any person moving from or relocating to the Township.
All real property owners within Polk Township shall be obligated to notify all occupants of improved property owned by them of the requirements of the this chapter. No property owner shall permit relocation to such property of any tenant or other permissive occupant unless and until this chapter has been complied with.
Any person in the business of transporting or moving personal property from one location to another shall be obligated to verify that the permit as described in this chapter has been issued prior to the moving or transporting of any personal property either to or from the Township.
Fee for a permit to be issued hereunder shall be set from time to time by the Polk Township Board of Supervisors by resolution.
A. 
Any person who violates or permits a violation of this chapter shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township before a Magisterial District Judge, pay a fine of not more than $600, plus all court costs, including reasonable attorneys' fees, incurred by the Township in the enforcement of this chapter. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Township are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.

B. 
An action to enforce or collect penalties under this chapter may be filed in any court of record. In the event of an enforceable action or action to seek civil penalties, all costs and reasonable counsel fees shall be recoverable.
